Together with a-letter to you dated November 29, 1973, counsel for the Saginaw.Intervenors in this proceeding for-warded a request for permission to reply to 'any responses" to Sagin'aw's; motion, now before the Commission, to " clarify" ALAB-123.
The purpose of this letter..is to express"the strong opposition of Consumers Power Company to the granting of that l
' request.
.The purported basis of the request.is~thc.t "the Commission has granted those parties who may oppose the Motion a period of almost two weeks to respond.
In view of'the importance l~
of~the. issue, Saginaw requests a similar period of time.
Under the rules of-the Commission relating to motions (1C
'CFR S 2.730(c)), it is expressly provided that'"The moving party shall have no rightito reply, except'as permitted by the pre-siding officer-or the Commission."
It is unusual for such re-l quests to be'made, let alone granted; and there is.no basis for the grant.of the request in the instant proceeding.
r-The Saginaw Intervenors filed an exhaustive, twenty-three page motion fully setting forth their views on the issue presen'.ed.
The implication that other. parties..are afforded an unusually long time-to" respond,to the motion is unwarranted.

ceedings on judicial review of ALAB-123 by permitting-~Saginaw IntervenorsLto file their-brief 40: days after the Commission-acts on:the.pending motion. ' The Solicitor of this Commission-has concurred in' deferring proceedingsibefore the Court, but has suggested;a 10-day interval ~in lieu of.the 40-days suggested by Saginaw.Intervenors.
If the Court adoptm such a procedure of deferral,-judicial' review;will be delayed-to the same extent as action-on the motion;pending before the Commission,and further delay in Commission action will result in equal delay'in the
' Court proceeding.
'However viewed, the grant' of. the instant request can only.
further. delay. ultimate resolution of this matter..No adequate
. grounds for such--further delay-have been demonstrated and the
~ Commission should not grant the request.
