Dear Mr. Eisenhut:

Our letter of June 4, 1982, written in response to Generic Letter No. 82-10, made certain commitments concerning completion dates for NUREG-0737 items scheduled for implementation after March 1, 1982. With regard to Item II.A.1.2 - Upgrade Emergency Support Facilities, we advised that full commu-nications capabilities at the Alternate EOF (AEOF) "should be in place and operational by 1-1-83." This letter is written to advise you that this commitment date will not be met.

At the time reference (a) was signed, the District had already laid out plans to expand its existing microwave transmission system to include the AEOF.

However, in August 1982, the regional telephone utility proposed to provide the necessary communications capability at a significantly lower cost than the District's microwave expansion. In the ensuing months, extensive contractual negotiations and legal reviews by both parties transpired which pertained primarily to protection provisions for nonperformance by the telephone utility. The problems in this area have been resolved and a suitable contract has been drawn up and is ready for approval by both parties.

The proposed contract allows the telephone utility ninety days to install and make operational the required communications. It is anticipated that the contract will be signed by January 1, 1983. Allowing for a ninety day instal-lation and testing period, it is expected that the full AEOF communications capability will be in place and fully operational by April 1, 1983.
