' Summary of Management Actions v

The governing Fitness for Duty Procedure underwent a major revision. Subsequently, the procedure was incorporated into the site's Station Operations Review Committee process, including a verification and validation prior to its publication. The following is

. an outline of the more significant changes.

The Nebraska Public Power District (District) increased its random testing rate from 50 to 100%

Effective 4/1/99, the District reduced its marijuana cutoff value from 100 ng/mi to 50 ng/ml.

The District incorporated a "zero tolerance" sanction regarding a positive drug test result. Those testing positive for drugs will be denied access following their first offense.

The District incorporated a lower cutoff value for alcohol testing individuals who are in a follow-up program due to a previous alcohol failure.

The District incorporated sanctions that will require the site to find evidence and confirmation of adulterants as a failure to cooperate and will qualify this evidence as a test failure.

The District incorporated the following statement with regard to prescription use of marijuana and cocaine.

Certain drugs listed in the Controlled Substance Act such as marijuana and cocaine may be legally prescribed and used in certain states. Howeve.r, federal regulations do not allow involvement with or possession or use r>

these drugs with or without a prescription by individuals assigned to Cooper Nuclear Station.

The District changed its policy regarding excusing individuals from the random generated list when they were unavailable due to temporary absences.

The District developed and administered an Enhanced Continuous Behavior Observation (CBO) Training Program as a supplement to the CBO training currently

. offered at the District. The course is intended for all managers, supervisors, and anyone who may be delegated as a responsible person to provide random or call-out notifications.

In addition, the District developed and distributed an information pamphlet that discusses the proper protocol for making a random notification and the concerns regarding sample hydration. The material was provided to all managers, supervisors, '

and those acting in a lead role.

Summary of Events Cooper Nuclear Station conducted seven for-cause tests. However, only one of these screens was positive. The following is a summary of those events:

One temporary licensee employee had provided a " pre-access" sample that upon analysis revealed an adulterant. The subject provided a second "for-cause" sample that screened positive for marijuana metabolite.

One licensee employee was tested "for-cause" because his supervisor felt that he smelled of alcohol. The test results showed that alcohol was present, however, the results were below the cutoff level.

One licensee employee was tested "for-cause" based on unusual behavior and excessive absenteeism. His drug and alcohol screens were negative. The individual was later denied access based on falsification of information.

One licensee manager was tested "for-cause" based on the smell of alcohol. The test results showed that alcohol was present, however, the results were below the cutoff level.

One licensee employee was tested "for-cause" on three separate occasions. Two of the three alcohol screens showed evidence of alcohol. However, the test results were below the positive cutoff value. The employee was referred to the Employee Assistance Program by his management team.
