Dear Mr. Horn:

On October 7,1997, the U.S. Nuclear Regulatory Commission (NRC) issued Generic Letter (GL) 97-04," Assurance of Sufficient Net Positive Suction Head for Emergency Core Cooling and Containment Heat Removal Pumps," to all holders of operating licenses or construction permits. By letter dated January 5,1998, Nebraska Public Power District (NPPD) provided Cooper Nuclear Station's response to GL 97-04. By letter dated August 14,1998, the staff requested additionalinformation with regard to the use of containment overpressure to ensure ,

adequate net positive suction head (NPSH) to the emergency core cooling (ECCS) pumps. {

NPPD responded to the staff's request by letter dated September 22,1998. By letter dated l November 24,1998, the staff stated that it did not agree with NPPD's conclusions and provided 1 its understanding of the Cooper licensing basis with regard to containment overpressure. By letter dated December 23,1998, NPPD responded to the staff's letter and committed to submit a license amendment request to permit containment overpressure to be credited in the ,

calculation of available NPSH for the ECCS pumps.

By letter dated June 15,1999, NPPD submitted a [equest for license amendment with regard to i the use of containment overpressure at Cooper Nuclear Station. The requested change involves the use of containment overpressure to ensure sufficient NPSH for the ECCS pumps following a design-basis loss-of-coolant accident (LOCA).

The staff has reviewed NPPD's submittals and supporting documentation. Based on this f review, the staff believes that NPPD has provided the information requested by GL 97-04.
