NOTICE OF VIOLATION South Carolina Electric & Gas Company Docket No. 50-395 V. C Summer Nuclear Station License No. NPF-12 During an NRC inspection conducted on July 27 through September 6. 1997.

violations of NRC requirements were identified. In accordance with the

" General Statement of Policy atj Procedures for NRC Enforcement Actions."

NUREG-1600, the violations are listed below:

A. Technical Specification (TS) 6.8.1.a requires that written 3rocedures shall be established, implemented and maintained covering t1e a)plicable procedures recommended in A)pendix A of Regulatory Guide 1.33. Revision

2. February 1978. Paragrap1 8.b.(1) of Appendix A states that the licensee should have instructions for reactor protection system calibrations.

Surveillance Test Procedures (STP). STP-345.001, " Delta T-TAVG Protection Loop 1 Calibration." Revision 8: STP-345.002. " Delta T-TAVG Protection Loop 2 Calibration." Revision 8; and STP-345.003. " Delta T-TAVG Protection Loop 3 Calibration." Revision 9, verify calibration of the three reactor coolant loop delta T-Tavg protection sensors and their associated signal processing equipment. Calibration of these sensors ensures proper setting of Overtemperature delta Temperature (OT delta T) and Overpower delta, Temperature (OP delta T) reactor trip setpoints.

Contrary to the above, on August 17. 1997, the licensee identified that procedures STP-345.001, STP-345.002 and STP-345.003 had not been maintained to ensure correct setting of the OT delta T and OP delta T reactor trip setpoints. The procedures listed an incorrect error tolerance for the OT delta T and OP delta T reactor trip setpoint time constants. This resulted in OT delta T and OP delta T time constants beingsetnonQonservativelyduringprotectionloopcalibrationsin Aprii 1996 and a small reduction in the Departure from Nucleate Boiling design margin.

This is a Severity Level IV violation (Supplement I).

B. 10 CFR Part 50, Appendix B. Criteria V. Instructions. Procedures, and Dre,t ngs, as implemented by the licensee's accepted quality assurance i

program, South Carolina Electric & Gas Company Operational Quality Assurance Han, Section 4 " Procedures." requires that activities affecting qualli.y shall be prescribed by documented instructions, procedures. or drawings of a type approariate to the circumstances and shall be accomplished in accordance wit 1 these instructions, procedures, or drawings.

Contrary to the above, on July 25. 1997 activities affecting quality were not accomplished in accordance with prescribed drawings. A guard pipe surrounding a portion of Reactor Makeup W ter System piping was not installed in accordance with safety-related drawing: E-304-794 and E-304-795. Pursuant to the provisions of 10 CFR 2.201. South Carolina Eitctric & Gas Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission. ATTN: Document Control Desk. Washington, D.C. 20555 with a copy to the Regional Administrator, Region 11. and a copy to j the NRC Resident Inspector at the V. C. Summer Nuclear Station, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be. clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if coni.csted, the basis for disputing the violation. (2) the corrective steps-

} that have been taken and the results achieved. (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previously docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice,'an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
