ENCLOSURE 1 NOTICE OF VIOLATION South Carolina Electric and Gas Company Docket No. 50-395 V. C. Summer License No. NPF-12 During the Nuclear Regulatory Commission (NRC) inspection conducted en April 6-10, 1987, a violation of NRC requirements was identified.

The violation involved a failure to properly classify a radioactive waste shipment.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the violation is listed below:

10 CFR 20.311(d) requires a licensee who transports radioactive waste to a land disposal facility to prepare all waste so that the waste is classified according to 10 CFR 61.55 and meets the waste characteristics requirements in 10 CFR 61.56.

10 CFR 61.55(a)(2)(1) requires that Class A waste which will not be segregated from other waste classes meet the minimum requirements of 10 CFR 61.56(a) and 10 CFR 61.56(b).

10 CFR 61.56(b)(1) requires that waste must have a structurally stable form that will generally maintain its physical dimensions and its fonn under expected disposal conditions.

Contrary to the above, on August 21, 1986, Radioactive Waste Shipment No. 0886-180-A containing ursolidified waste in a steel liner was imprepsrly classified as Class A-stable waste in that the waste was not in a structurally stable form.

This is a Severity Level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, South Carolina Electric and Gas is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including:

(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
