Dear POI Officers Pursuant to the federal Freedom of Infor1 nation Act, 5 U.S.C. S 552, I request access to an3 copies of the NRC investigative report on a Dec. 31, 1986, incident at the Davis-Besse Nuclear Power Station, and oftheoriginalallegationofdrunkenneshaseniormanagerat_the q n'g i plant on this date. This allegation also pertains to the fitness for duty program at the plant run by Toledo Edison Co. I also request access to and copies of later allegations pertaining to the same manager and-incident. These allegations include but are not limited to that numbered RIII-67-A-0001. The original allegation was received by NRC Region III l and convoyed to TE President Paul Smart as an enclosure to a letter from James G. Keppler, Regional Administrator, dated Jan. 29, 1937.

Later allegations were made to an NRC resident inspector at the plant in or about July 1987. However, I am requesting access to and copies of all allegations pertaining to this senior manager and the Dec. 31, 1986, incident that were received by NRC officials and representatives'.in11987 and 1988. I also request access to and copies of the investigative report on this incident prepared by the NRC Region III off' ice of '

investigations. This report was concluded on or about July 5 of this year. Attached are news articles pertaining to this report. I am also requesting access to and copies of the investigative report on this incident prepared by the NRC's Office of Investigatiorts in I Maryland.

The FOI Act provides for a waiver or reduction of fees if disclosure could be considered as "primarily benefiting the general public."

I am a journalist employed by the Plain Dealer Publishing Co.,

publisher of the (Cleveland) Plain Dealer (PD), and I intend to use the requested information as the basis for an article. Readers of the PD, which circulates to approximately 450,000, most of them in Ohio, reside in those areas served by the Davis-Besse plant. Readers of the Plain Dealer include an estimated 60,000 shareholders in

These homeowners as well as home renters and area business and industry help pay Davis-Besse plant costs on their electric bills. Readers of the PD are interested and have the right to know details of allegations concerning activitics at the plant, and results of NRC's investigation of those allegations.

I have reported on nuclear energy matters for the PD for approximately one year, have reviewed hundreds of NRC documents in that time, attended technical conferences on nuclear matters and participated in a seminar-on the functioning of the Perry Nuclear Power Plant. I have also -

reviewed hundreds of documents pertaining to the operating history and technical problems experienced by the Davis-Desse plant. Thus, I am equipped to report on the requested documents for the public.

Therefore, I ask that you waive all search and duplication fees.

If you deny this request, however, I am prepared to pay reasonable fees up tn $?90, but please notify me of the_es A ted charges beforJ you begin to process my request. ,

If my. request is denied in whole or part, I ask that you-justify all j deletions by reference to specific exemptions of the Act. I will also l expect you to release all reasonably segregable portions of otherwise  ;
