regarding your letter or February 17, 1988 to Mr. Alvin Koplan of CEI on.the exigent technical specific.ition change requested by CEI's letter of i

February 12, 19BB iPY-CEI/NRR-0606 L).

This request would-modify T.S.

3.4.3.1 to permit continued plant operation with the upper drywell air cooler condensote flow rote monitoring j

system inoperable, provided that the drywell floor decin flow monitoring system is operable.

These comments are based solely on your letter and enclosed Federal Register

notice, the licensee's request hos not yet arrived in the LPDR.

First, OCRE notes that the sole motivation for the amendment request, and ror its emergency classification, is to avoid, the costs of a shutdown, which would result if the present T.S.

were odhered to.

DCRE uculd question whether this is o

valid legal basis for on operating license omendment.

Lost year the D.C Circuit Court of Appeois ruled thot the NRC may not consider costs to licensees in setting or enforcing those standards necessary to ensure odequate protect' ion or the public health and sorety.

Union of Concerned Scientists v.

NRC, 824 F.2d 108 (1987).

Section 182 orlthe Atomic Energy

Act, which the Court determined required the Commission to set'.stondords, regardless of costs to licensees, which would provide adequote protection to the

Second. it appears that this omendment is o

permanent remedy for whot should be only a temporary problem.

There is no indication that this omendment is or short duration.

There is no reason why, at the next unplanned shutdcNn, or at the lost one, occurring Just lost week, the system could not be repaireo and returned to service.
