Dear Mr. Hartman:

This is to confirm our telephone conversation of yesterday concerning your willingness to appear as a witness in the Commission's i inquiry into leak rate data falsifications at TMI-2 in 1978-79. We appreciate your cooperation in this matter.

As we discussed. I am enclosing copies of all of the interviews and i statements taken from you on the subject of leak rate tests which have

< been included in the record of the present inquiry. The principal purpose of your appearance will be to answer questions from the NRC Presiding Board about your prior statements. There are nine such statements or interviews comprising some 700 pages of material. We j, would appreciate it if you would review these materials to determine

' whether they include all of the significant information you have on this  ;

subject. We assume that many of these interviews cover much the same 4 ground. We would also appreciate it, therefore, if you could help us narrow the principal focus of our review to, say, two or three of these documents. For example, does the Faegre & Benson interview of April 27-28, 1986, cover most of the important points?

The evidentiary hearing will begin with expert witness testimony on l

September 8, 1986. We expect to call you as a witness sometime in late

! September and I will be in touch with you about a specific date as that time approaches. Recognizing that you will appear voluntarily, I am nevertheless enclosing a subpoena to ensure that we will be in a j
