THREE MILE ISLAND NUCLEAR GENERATING STATION, UNIT 1,10 CFR PART 50 APPENDIX R EXEMPTION REQUEST (TAC NL. M97747)

Dear Mr. Langenbach:

By letter dated December 31,1996, as supplemented by letters dated September 8,1997, and December 30,1997, May 21,1998, October 14,1998, November 25,1998, and December 23, 1998, GPU Nuclear, Inc., licensee for the Three Mile Island Nuclear Generating Station, Unit 1, submitted a request for an exemption from the requirements of Title 10 of the Code of Federal Reaulations. Part 50, Appendix R, Section Ill.G.2, to the extent that they require the enclosure of cable and equipment and associated non-safety-related circuits necessary to achieve and maintain safe shutdown in a fire barrier having a 1-hour fire endurance rating.

The staff has completed its review of the request for exemption. The request for exemptiun is granted for fire zones / areas AB-FZ-4, FH FZ-1, CB-FA-1, FH-FZ-6, ISPH-FZ 1, and ISPH-FZ-2, subject to the conditions set forth in the exemption. The request for exemption has been denied for fire zones AB-FZ-3, AB-FZ-5, AB-FZ-7, and FH-FZ-2.

It is our intent in the near future to send you another " consent to confirmatory order" letter similar to the one we sent to you on April 27,1998, in order to confirm your November 23, 1997, con',mitment to complete finalimplementation of Thermo-Lag corrective actions by December 31,1999. This letter would again request a response within 10 business days.

The enclosed safety evaluation documents the NRC staff's review of this request. Sandia National Laboratory (SNL) provided technical assistance to the staff in the review of cable functionality issues. The contractor's technical evaluation report (TER) is attached to the staff's safety evaluation. This completes our review under T.'C No. M97747.
