DOCKETS 50-266 AND 50-301 MODIFICATION OF WPDES PERMIT POINT BEACH NUCLEAR PLANT Enclosed is a copy of the modified Wisconsin Pollutant Discharge elimination System (WPDES) Permit WI-0000957-3 for the Point Beach Nuclear Plant, Units 1 and 2. This permit replaces the original permit issued on October 21, 1983, and adds the categorical total residual chlorine effluent limit and associated conditions and monitoring requirements.

This modified permit is submitted for your information in accordance with our commitment to the NRC to provide a copy.of any changes to the WPDES permit. This commitment is documented in the NRC Safety Evaluation Report dated March 11, 1983.

Dear Mr. Fay:

The request for modification of Wisconsin Pollutant Discharge Elimination System (WPDES) Permit No. WI-0000957-3, initiated by Ms. Mary Alyce Pezzi on September 16, 1986, has been processed by this Department. This modification adds the categorical total residual chlorine effluent limit and associated conditions and monitoring requirements.

The permit, which is attached, replaces the original permit issued on October 21, 1983. Please replace the original permit with the attached modified permit. All discharges from this facility and actions or reports relating thereto shall be in accordance with the terms and conditions of the original permit, as modified.

The conditions of this modification were determined using the permit application, information from your company's permit file, comments received nuring the public notice period, Wis. Administrative Codes NR 200, NR 203, NR 205, NR 104, NR 290, NR 217, and Federal Registers 40 CFR Part 423.

In accordance with this permit, discharge monitoring report forms are required to be submitted by you to the Department on a periodic basis. Blank copies of these reports and forms and instructions for completing them will be mailed to you under separate cover within sixty days.

The WPDES permit program has been approved by the Administrator of the U.S.

Environmental Protection Agency pursuant to Section 402(b) of the Federal Water Pollution Control Act Amendments of 1972 (33 U.S.C. Section 1342 (b)).

The terms and conditions of this permit are accordingly subject to enforcement j under Sections 147.21 and 147.29, Wisconsin Statutes and Section 309 of the 1 Federal Act (33 U.S.C. Section 1319). (

The Department has the authority under Chapter 147, Wis. Statutes to establish ,

effluent limitations, monitoring requirements, and other permit conditions for discharges to groundwaters and surface waters of the State. The Department also has the authority to issue, reissue, modify, suspend or revoke WPDES permits under Chapter 147 Wis. Statutes. His. Administrative Code Chapters NR 200, NR 203, NR 205, NR 104, NR 290, and NR 217 have been adopted by the Department pursuant to this statutory authority.

To challenge the reasonableness of or necessity for any term or condition of

'the attached permit, Section 147.20. His. Statutes, and Chapter hR 203, Wis.

Administrative Code require that you file a verified petition for review with the Secretary of the Department of Natural Resources within 60 days of the date of this letter. This notice is provided pursuant to Section 227.48, Wisconsin Statutes, as renumbered by 1985 Wisconsin Act 182.
