(2) The permittee shall monitor this characteristic at the sample frequency and sample type as Indicated

' above, but may report this data on a yearly basis. The report shall be on forms acceptable to the Department and shall be submitted each February 28 for the previous year.

4 (3) One grab sample for total residual chlorine shall be collected during the peak chlorine discharge of

' each chlorination event. The reported value shall be the naminum of the events. The peak discharge shall be identified by developing a total residual chlorine discharged versus time curve. This curve i shall be developed within 90 days following commenceeent of chlorination and shall be submitted to the

Department within 120 days after commencement of chlorination.

G. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on the effective date of the permit and lasting until December 31, 1987 the p rmittee is authorized to land spread sludge f rom an extended aera*'on treatment system.

(1) This discharge shall be limited and monitored by the permittee as specified below.

Samples taken in compliance with the monitoring requirements specified below shall be taken at the following location: outfall 005 prior to land spreading. Annual reports shall be subeitted to the Department by February 1 of each year.

  • Annual senitoring is required at a minimum unless the Sludge Management Report Approval Specifies more f r:quent monitoring.

(2) Hydraulic Application Rate: The hydraulic application rate for the sludge shall be such that the annual nitrogen loading rate shall not exceed the recommended nutrient value for the crops grown on the field ar.d the annual and cumulative metal loading rates do not exceed those specified in NR 214.11, Wisconsin Administrative Codes.

(3) The permittee shall maintain a daily log of the volume of sludge hauled and identification of the site it was hauled to. This record must be available for inspection at the time of a compliance monitoring survey by Department personnel.

'(4) Calibration of the tank on the truck can be used to compute total daily flow.

(5) The permittee shall monitor the sludge for percent total solids, percent total nitrogen, percent ammonium nitrogen, pH, percent total phosphorous, percent total potassium, cadmium, copper, lead, nickel, mercury, zinc, and boron; and report the values obtained on a dry weight basis, except for percent solids and pH.

(6) No discharge to the system may have physical or chemical characteristics which prevents the proper ope ation of the land disposal system.

(7) Discharge to the land disposal system shall be limited so that during surface spreading all of the sludge and any precipitation falling onto or flowing onto the disposal fleid shall not overflow the perimeter of the system.

(8) Vehicles used for transporting and spreading the sludge shall be designed to be kept tightly closed to prevent spillage or escape of odors while in transit or storage.

(9) Sludge may not be land spread on land with a slope greater than 12%. During the period from December 15 through March 31 sludge may not be land spread on land with a slope greater than 6% unless the wastes are injected immediately into the soil.

(10) Sludge may not be surface spread closer than 500 feet from the nearest inhabited dwelling except that this distance may be reduced with the dwelling owner's written consent.

G. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS - continued (11) Sludge may not be spread closer than 1,000 feet from a public water supply well or 250 feet from a private water supply well.

(13) Sludge may not be land spread within 200 feet of any surface water unless a vegetative buf fer strip is maintained between the surface watercourse and the land spreading system, in which case a minimum separation distance of at least 100 feet is required between the system and the surface watercourse.

(13) Depth to groundwater and bedrock must be greater than 3 feet from the land surface elevation during use of any site.

(14) The vehicle used for land spreading the sludge shall be moving forward at all times when discharge is occurring unless the vehicle is equipped with a high pressure spray nozzle which is used to evenly distribute the wastes over the land. In addition the vehicle shall be equipped with a distribution system having the ability to spread the waste evenly over a width of 5 feet or greater.

(15) The permittee may develop additional land spreading sites other than those identified, provided they are approved in writing by this Department. The Department may issue a written notice to withdraw approval to use any site that is found to be environmentally unacceptable. This written approval or withdrawal shall be deemed as authority to use or reject the site until such time as the permit can be modified in accordance with Section 147.03. Wisconsin Statutes.

(16) Sludge may not be land spread in a f' cod-aw.

(17) Sludge may not be land spread within 50 feet of a property line road or ditch unless the sludge is incorporated with the soil, in which case a minimum separation distance of at least 25 feet is required.

H. OTHER SPECIAL CONDITIONS

1. Transf ormer Fluids There shall be no discharge of polychlorinated biphenyl compounds such as those commonly used for transformer fluid.
2. Intake Screea Discharaes There shall be no discharge of floating or submerged debris from intake screen washing operations. " Debris" means solid material which would be caught by a screen with a mesh size 3" x 3". -

I. OTHER SPECIAL CONDITIONS

1. Recertino
a. Monitoring repoj ta and reports required by Sections 8, 17, 20, 21 and 23 of Part II of this permit e all be signed; (1) for a corporation by a principal executive officer of at least the level of Vice President or his duly authorized representative having overall responsibility for the operation of the facility for which this permit is issued, (2) for a partnership by a general partner, and (3) for a sole proprietorship by the proprietor, except that (4) in the case of reports required by Sections 21 and 23. the individual required to sign in accordance with this subsection may authorize another individual to sign such reports in his absence.
b. Monitoring results obtained during the previous month shall be summarized and reported on Discharge Monitoring Report Forms postmarked no later than the 28th day of the month following the completed reporting p;riod. The first report is due on November 28, 1983. Dup 1tcate signed copies of these reports shall be submitted to the:

, l. Duty to comply The pemiTree snais comply with all conditions of the permit. Any permit noncompilance is a violation of the permit and is grounds for enforcement action, pomit rewcation or modification, or denial of a permit reissuance application.

2. Aermit actions As previoea in s. i47.03, Stats., af ter notice and opportunity for a hearing the permit may be modified or revoked and reissued for cause. If the permittee files a request for a pomit modification, revocation or reissuance, or a notification of planned changes or anticipated noncompliance, this action by itself does not rollove the permittee of any permit condition.
3. Property rights The permit does not convey any property rights of any sort, or any exclusive privilege. The permit does not authorize any injury or damage to private property or any Invasion of personal rights, or any infringement of federal, state or local laws or regulations.

4 Inspection and entry .

The pemittee snaii allow an authorized representative of the Department, upon the presentation of credentials, to:

a. . Enter upon the permittee's premises where a regulated f acility or activity is located or conducted, or where twcords are required under the conditions of the permit;
b. Have access to and copy, at reasonable times, any records that are required under the conditions of the pemit;
c. Inspect at reasonable times any f acilities, equipment (including monitoring and control equipment),

practices or operations regulated or required under the permit; and

d. Sa9ple or monitor at reasonable times, for the purposes of assuring permit compilance, any substances or paraseters at any location.
5. Recordinc of results For eacn erriuenT measurement or sample taken, the permittee shall record the following Infomation.
e. The date, exact place, method and time of sampling or measurements;
b. The Individual who performed the sampling or measurements;
c. The date the analysis was performed;
d. The Individual who performed the analysis;
e. The analytical techniques or methods used; and
f. The results of the analysis.
6. Records retention The perm 6TTee snai t retain records of all monitoring Information, including all calibration and maintenance records and all original strip chart recordings for continuous monitoring Instrumentation, copies of all reports required by th9 permit, and records of all data used to complete the application for the permit for a period of 6t least 3 years f rom the date of the sample, measurement, report or application. The Department may request that this period be extended by issulng a public notice to modify the pemit to extend this period.
7. Signatory reculrenent All appi eceTaons, reports or Infomation submitted to the Department shall be signed for a corporation by a responsible corporate of ficer including a president, secretary, treasurer, vice president or manager; and for a municipality by a ranking elected of ficial; or other person authorized by one of the above and who has responsibility for the overall operation of the f acIllty or activity regulated by the permit. The representa,tive shall certify that the Information was gathered and prepared under his or her supervision and based on Inoulry cf the people directly under his or her supervision that, to the best of his or her knowledge, the Information is true, accurate and corplete.

8 Compliance schedules Repw a v i wv i i a%o vr noncomplInnce with Interim and final requirements contained in any compilence schedule cf the permit shall be submitted in writing within 14 days af ter the schedule date, except that progress reports shall be submitted In writing on or before each schedule date for each report. Any report of for. compliance shall include the cause of noncompliance a description of remedial actions taken and an estimate of the effect of the noncompliance on the pemittee's a$111ty to meet the remaining schedule dates.

control of a permitted f acility, the prospective owner or operator shall file a new pemit application and shall file a stipulation of permit acceptance with the Department WIDES permit section. The Department may recut re modification or revocation and reissuance of the permit to change the name of the permittee and to reflect the requirernents of ch. 147, Stats.

19. Solti reporting The permittee snell notify the Department in accordance with ch. NR 158, in the event that a spill or accidental release of any material or substance results in the discharge of pollutants to the waters of the state at a rate e or concentration greater than the ef fluent limitations established in the permit, or the spill or accidental release of the material is unregulated In the permit, unless the spill or release of pollutants has been reported to the Department under condition 17.
20. Planned che s in dt"CI5Ptr5 Fit"6 ss.147.02(4)(b) and 147.14(l), Stats., the permittee shall report to the Department any f acility expansion, production increase or process modifications which will result in now, different or increased discharges of pollutants. The report shall either be a new permit application or, if the new discharge will not violate the ef fluent limitations of the permit, a written notice of the new, dif ferent or increased discharge.

The notice shall contain a description of the new activities, an estimate of the new, different or increased discharge of pollutants and a description of the effect of the new or increased discharge on existing waste treatment f acilities. Following recelpt of this report, the Department may modify the permit to specif y and

!Imit any pollutants not previously regulated in the permit.

Note: The notification should be directed to the Industrial Wastewater Section.

21. Increased discharge of toxic pollutants
a. ' Routine or f requant increase' . The permittee shall notify the Department In writing as soon as It knows or has reason to believe that any activity has occurred or will occur which would result, o9 a routine or frequent basis, In the discharge of any toxic pollutant which is not limited In the permit, If that discharge exceeds the highest of the following levels.

(l) One hundred micrograms per Iiter (100 ug/1);

( 2) Two hundred micrograms per liter (200 ug/l) for acroteln and acrylonitrile; five hundred micrograms per liter (500 ug/l) for 2,4-dinitrophenol and for 2-methyl-4,6-dinitrophenol; and one milligram per IIter (I mg/l) for antimony;

( 3) Five times the maximum concentration value reported for that pollutant in the permit application; or

( 4) A notification level greater than the level In sections (1), (2), or (3) above, which the Department has Included as a special condition of the permit.

b. 'Nonroutine or Infrequent increase'. The permittee shall notify the Department In writing as soon as it knows or has reason to believe that any activity has occurred or will occur which would result, on a nonroutine or Infrequent basis, in any discharge of a toxic pollutant which is not limited in the permit, if that discharge will exceed the highest of the following levels.

(1) Five hundred micrograms per liter (500 ug/l);

( 2) One milligram per liter (I mg/l) for antimony;

( 3) Ten times the maximum concentration value reported for that pollutant in the permit application; or

( 4) A notification level greater than the level in sections (1), ( 2), or (3), abo w which the Dep etment has included as a special condition to the permit.

22. Duty to halt or reduce activity Upon iaiiuri or impa.rmenT oT Treatment f acility operation, the permittee shall, to the extent necessary to maintain compilance with its permit, curtall production or wastewater discharges or both until the treatment f acility operations are restored or an alternative method of treatment is provided.
23. Bypass The permittee may bypass waste treatment f acIIItles if this is necessary for the essential maintenance of the facilities and if the bypass does not exceed permit effluent limitations. The permittee may also bypass if the bypass is due to runof f in excess of the 10 year, 24 hour2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> rainf all event and the bypass is designated as a specific discharge point in the WR)ES permit. All other bypasses of waste treatment facilltles, including diversion of wastewater from land disposal systems to surf ace waters, are prohibited unless the following conditions are met:
a. The bypass Is necessary to prevent loss of life, personal Injury or severe property damage;
b. There are no feasible alternatives to the bypass, such as the use of auxillary treatment f acilities, retention of untreated wastes or maintenance during normal periods of equipment downtime; and
c. The permittee submitted written notice 10 days before the date of the bypass and the Department's district of fice wastewater supervisor had approved the bypass in writing prior to its occurrence; or
d. In 1he event of an unanticipated bypass, the permittee notifled the Department verbally within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> and in writing within 5 days of each unanticipated bypass.
