Dear Mr. Himmel:

I agree with your letter of June 5,1986 in that there is no present occasion for an answer to be filed by Mr. Wallace in connection with the Advisory Opinion and Notice of Hearing (CLI-86-09) of May 15, 1986. If he files an answer to any petition for leave to intervene, I expect such answer to be filed within ten days after the service of the petition in accordance with 10 CFR S 2.714(c). If the NRC Staff takes a position against Mr. Wallace, his answer to the Staff's position should also be filed within ten days following service of the Staff's pleading.

Your letter of June 5,1986 is attached hereto for service upon interested persons. If at least one petition for leave to intervene is granted or if the NRC Staff advocates a position against Mr. Wallace, an official service list will be established. In the interim, please serve any communication respecting this natter on those listed on the service certificate by the Docketing and Service Branch, an updated copy of which is attached to this letter.

Please note that the style of this proceeding has been changed as indicated above.
