Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending April 7, 2023 U.S. Nuclear Regulatory Commission Held a Public Meeting Related to the Reactor Oversight Process On April 5, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting (Agencywide Documents Access and Management System Accession No. ML23086C004) related to the Reactor Oversight Process (ROP) to discuss (1) changes to the assessment program resulting from SRM-SECY-22-0086, Recommendations for Revising the Reactor Oversight Process Assessment Program, (2) an update on experiences from the first Commercial Grade Dedication inspections (ML23088A394), (3) an announcement regarding alert and notification system changes made by offsite response organizations that may impact certain licensees (ML23073A021), and (4) an update on the staffs proposed recommendations from the safety culture effectiveness review (ML23082A044). The NRC staff also presented the response to FAQ 23-01, DC Cook Unit 1 Unplanned Scram Exemption Request (ML23090A226). Attendees included the industrys ROP Task Force, NextEra Energy, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for May 18, 2023.

SHINE Technologies LLC Informed the NRC of a Potential Delay in Their Construction Schedule On April 5, 2023, SHINE Technologies LLC (SHINE), informed the staff that obtaining finances supporting facility construction has slowed due to the current economic conditions, which may lead to a delay in their construction schedule. SHINE plans to take steps to minimize potential construction delays while reducing expenses, including assuming the role of lead construction management along with focusing on procurement and certain fabrication activities. Through ongoing construction inspection activities, the NRC staff will continue to ensure that facility construction is conducted at an appropriate level of quality.

NRC Held Public Workshop on the Instrumentation and Controls Licensing Framework for Advanced Reactors On April 4, 2023, the NRC staff continued its public workshops on the instrumentation and controls (I&C) licensing framework for Advanced Reactors in a meeting with stakeholders. The workshops are part of the agencys efforts to optimize reviews of future license applications and ensure a common understanding amongst the NRC staff and potential applicants. This workshop continued discussions on specific industry questions regarding the use of alternative international I&C safety standards and how their use impacts digital I&C licensing decisions and applicability to NRC regulations. The staff is planning for its next public workshop in May to continue discussions on specific areas, including the implementation of the licensing basis event selection and structure, system, and component classification methodology described in the Licensing Modernization Project.

NRC Issues Letter to the U.S. Environmental Protection Agency Regarding the Potential Impacts of its Rule Banning DecaBDE on the Nuclear Industry On March 31, 2023, the NRC staff issued a written response to the U.S. Environmental Protection Agency (EPA) regarding potential impacts of the EPA rule banning DecaBDE on the nuclear industry (ML23090A159). On January 6, 2023, EPAs Title 40 of the Code of Federal Regulations Part 751 rulemaking went into effect that restricts the manufacturing, processing, and distribution of DecaBDE. The distribution-related provisions of this rulemaking have been highlighted as having an adverse impact on the ability of nuclear power plants to maintain or replace equipment needed for continued operation. In addition to the written response, NRC staff has met regularly with EPA and U.S. Department of Energy staff in relation to the DecaBDE ban.

Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending April 7, 2023 Three Mile Island Station, Unit 2, Possession Only License Amendment On March 31, 2023, the U.S. Nuclear Regulatory Commission (NRC) issued license amendment 67 to the Three Mile Island (TMI) Station, Unit 2, Possession Only License in response to TMI-2 Solutions License Amendment Request dated February 19, 2021 (Agencywide Documents Access and Management System Accession No. ML21057A046). This amendment eliminates certain technical specification requirements based on the current radiological conditions; relocates certain administrative controls to the Decommissioning Quality Assurance Plan; and removes multiple license conditions that are no longer applicable. Under this amendment, the licensee can conduct source reduction and some building demolition; however, buildings that are eligible for the National Registry of Historic Property will not be authorized for demolition until all environmental impacts have been evaluated.

Public Meeting on the Proposed Rule-Renewing Nuclear Power Plant Operating Licenses

- Environmental Review On April 4, 2023, the staff held a hybrid public meeting on the Proposed Rule - Renewing Nuclear Power Plant Operating Licenses - Environmental Review. The meeting was held in King of Prussia, PA. There were 18 members of the public in attendance - 2 attended in person and 16 joined remotely. The staff discussed the proposed rule to facilitate submissions of public comments. The public comment period on the proposed rule ends on May 3.

Public Meeting on the Proposed Rule-Renewing Nuclear Power Plant Operating Licenses

- Environmental Review On April 6, 2023, staff held a hybrid public meeting on the Proposed Rule - Renewing Nuclear Power Plant Operating Licenses - Environmental Review. The meeting was held in Decatur, GA. There were 19 members of the public in attendance - 1 attended in person and 18 joined the meeting remotely. The staff discussed the proposed rule to facilitate submissions of public comments. The staff conducted six hybrid meetings in March and April in various locations across the country.

Final Environmental Review Permitting Action Plan On April 4, 2023, in response to the March 6, 2023, memorandum from the Office of Management and Budget (OMB), M-23-14, Implementation Guidance for the Biden-Harris Permitting Action Plan, the NRC submitted its final environmental review Permitting Action Plan (ML23075A336) to OMB, the Council on Environmental Quality, and the Federal Permitting Improvement Steering Council. The NRCs final plan outlines the agencys strategies and processes to implement the five elements of the OMB memo including: accelerating environmental permitting through early cross-agency coordination; establishing clear environmental review timelines; early and meaningful engagement with States, Tribes, Territories, and local communities; improving responsiveness; and adequately resourcing agencies to improve environmental review outcomes.
