Items of Interest Week Ending March 24, 2023 NRC Issues Letter Explaining the Results of Its Acceptance Review of the NuScale Standard Design Approval Application On March 17, 2023, the U.S. Nuclear Regulatory Commission (NRC) issued a letter (Agencywide Documents Access and Management System Accession No. ML23058A160) explaining the results of its acceptance review of the NuScale Standard Design Approval Application (SDAA) (ML22339A066). In the letter, staff identified technical sufficiency issues related to the phenomenon of density wave oscillation (DWO) that will require supplemental information to support the issuance of a reliable schedule. As a result, the NuScale SDAA will be considered tendered, but not docketed, until the DWO request for supplemental information is resolved. In the meantime, the staff will begin a technical review of the parts of the SDAA that are not impacted by DWO.

NRC Issues Information Notice Clarifying Reporting Requirements when a Fixed Gauge Shutter is Stuck in the Closed Position On March 17, 2023, the NRC issued the Information Notice entitled, Reporting Clarification when a Fixed Gauge Shutter is Stuck in the Closed Position, (ML22326A295), to inform licensees that according to the regulations, a fixed gauge shutter that is stuck in the closed position does not need to be reported.

NRC Holds Partially Closed Meeting with Holtec Decommissioning International on Proposed Regulatory Path to Restart Palisades Nuclear Generating Station On March 20, 2023, the NRC held a partially closed meeting with Holtec Decommissioning International, LLC (HDI), to discuss the proposed regulatory path to restart Palisades Nuclear Generating Station (ML23072A404). HDI presented its plan, which involves returning the plants operating license and licensing basis to that which existed just prior to shutting down through the use of an exemption from Title 10 of the Code of Federal Regulations 50.82(a)(2) and a series of license amendments. The meeting was attended by over 200 people, including several reporters and representatives from Congressional offices.

Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending March 24, 2023 Monticello Nuclear Generating Plant Public Meeting On March 22, 2023, the U.S. Nuclear Regulatory Commission (NRC) conducted an open house and in-person environmental scoping meeting for the Monticello Nuclear Generating Plant, Unit 1, subsequent license renewal application. At the open house, NRC staff addressed public and media questions regarding the license renewal process and a recent tritiated water leak at Monticello. Approximately 30 members of the public and several plant representatives attended the scoping meeting. Region III staff started the meeting with a statement assuring the safety of the public, their drinking water, and the environment, and Nuclear Reactor Regulation and NMSS staff discussed the safety and environmental reviews and answered scoping process questions. A second Monticello environmental scoping meeting will be held virtually via TEAMS on March 29, 2023 (Agencywide Documents Access and Management System Accession No. ML23081A504).

Department of Energy Isotope Programs Virtual Roundtable on Accelerator-Produced Actinium-225 On March 21, 2023, NMSS and Region III staff, as well as an Agreement State staff from Wisconsin, presented at the Department of Energy (DOE) Isotope Programs virtual roundtable on accelerator-produced actinium (Ac)-225. The DOE is a non-commercial producer of Ac-225, which is used in targeted radiotherapy for cancer treatment. This meeting was open to the public for the purpose of presenting and answering questions on regulating Ac-225 with the Ac-227 impurity. Topics discussed included: regulatory requirements for decommissioning financial assurance, Agreement State compatibility, and NRC and Agreement State licensing experience and observations. The DOE and participants expressed their gratitude for the meeting that was attended by approximately 272 participants.

On March 22, 2023, the NRC published a notice in the Federal Register (88 FR 17164) reopening the public comment period for a proposed rule that was published on February 13, 2023 (88 FR 9106), to renew, for 40 years, the initial certificate and Amendment Nos. 1 through 15 of Certificate of Compliance No. 1014. The renewal of the initial certificate and Amendment Nos. 1 through 15 revises the certificate of compliances conditions and technical specifications to address aging management activities related to the structures, systems, and components important to safety of the dry storage system to ensure that these will maintain their intended functions during the period of extended storage operations. The public comment period closed on March 15, 2023. The comment period for the document published on February 13, 2023, has been reopened. Comments are due by April 14, 2023.

Draft Regulatory Guide: Perimeter Intrusion Alarm Systems; Proposed Guide; Extension of Comment Period; 10 CFR Part 73 [NRC-2022-0157]

On March 22, 2023, the NRC published a notice in the Federal Register (88 FR 17165) extending the comment period for a draft regulatory guide (DG) that was published in the Federal Register on February 21, 2023 (88 FR 10481) which solicited public comment on DG-5065, Perimeter Intrusion Alarm Systems. The DG is proposed Revision 4 to Regulatory Guide 5.44 of the same name. This proposed revision describes an approach acceptable to the NRC staff for meeting intrusion detection sensors and detection methods. The public comment period was originally scheduled to close on March 23, 2023. The due date for comments requested in the document published on February 21, 2023, is extended. Comments are due by May 22, 2023.

The purpose of this contract is to conduct a comprehensive review of the existing program and make program improvement recommendations to increase staff & management participation, develop new competency models, and refine & update existing models as needed. In addition, the purpose of this contract is to identify and create development opportunities for individual competencies for staff to leverage to improve their job performance. The period of performance is from March 27, 2023, through September 26, 2023, with one option period. The total potential value of the contract can be up to $1,666,511.55.
