specifically, an investigation based on allegations that the DNFSB Chair had ordered a contractor do to work outside of a contract's scope of work and without appropriate supervision and that the Chair had allegedly violated the FAR by inappropriately providing an evaluation for the contract employee to the contractor's program manager. This investigation was summarized in the Semiannual Report to Congress for April 1, 2023 through Sept. 30, 2023.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending January 12, 2024 Enforcement Policy: Revision to Policy Statement; 10 CFR Part 2; NRC-2023-0196 On January 12, 2024, the U.S. Nuclear Regulatory Commission (NRC) published a revision to its Enforcement Policy in the Federal Register (89 FR 2111). This revision addresses the requirements of the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, which requires Federal agencies to adjust their maximum civil monetary penalty amounts annually for inflation. This action is effective on January 12, 2024.

Adjustment of Civil Penalties for Inflation for FY 2024: Final Rule; 10 CFR Parts 2 and 13; NRC-2022-0045 [RIN 3150-AK73]

On January 12, 2024, the NRC published a notice in the Federal Register (89 FR 2112) amending its regulations to adjust the maximum civil monetary penalties it can assess under statutes enforced by the agency. These changes are mandated by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. The NRC is amending its regulations to adjust the maximum civil monetary penalty for a violation of the Atomic Energy Act of 1954, as amended, or any regulation or order issued under the Atomic Energy Act from $351,424 to

$362,814 per violation, per day. Additionally, the NRC is amending provisions concerning program fraud civil penalties by adjusting the maximum civil monetary penalty under the Program Fraud Civil Remedies Act from $13,508 to $13,946 for each false claim or statement.

This final rule is effective on January 12, 2024.
