Office of Nuclear Reactor Regulation Items of Interest Week Ending May 26, 2023 Constellation Submits Letter to NRC Stating that the Digital Modification at Limerick is Delayed and the Initial Installation of the Modification is Being Pivoted from Unit 1 to Unit 2.

On May 23, 2023, Constellation Energy Generation, LLC (Constellation or Licensee) submitted a letter (Agencywide Documents Access and Management System Accession No. ML23143A342) to the U.S. Nuclear Regulatory Commission (NRC) stating the digital modification at Limerick is delayed and the initial installation of the modification is being pivoted from Unit 1 to Unit 2. The licensee stated that the final design activities for the [digital modification] have been delayed due to additional design refinement iterations. Because of the delay, Constellation is changing its planned installation from Unit 1 in April 2024 to Unit 2 in April 2025. The licensee provided revised dates for information (i.e., supplements) needed to complete the initial license amendment request and new dates for parts of the license amendment request it plans to revise. The delay by the licensee will change the review completion date communicated to the licensee (i.e., March 11, 2024). Based on the revised and new dates provided by the licensee, the NRC staff will update the Limerick digital instrumentation and controls license amendment review schedule, including estimated review completion date.

NRC Held its Second Public Meeting with Holtec Decommissioning International, LLC (HDI), to Discuss the Proposed Regulatory Path to Restart Palisades On May 24, 2023, the Office of Nuclear Reactor Regulation and the Office of Nuclear Material Safety and Safeguards held its second public meeting with Holtec Decommissioning International, LLC (HDI), to discuss the proposed regulatory path to restart Palisades (ML23072A404). As part of the discussion, HDI laid out three key factors that would lead it to a decision on whether or not to move forward with the project: (1) Department of Energy loan, (2) legislative action from the state of Michigan, and (3) a power purchase agreement. HDI expects to make its decision on restart during the July - October time frame and engage the staff on pre-application dialogue shortly following its decision, with a goal to get all restart submittals to the NRC within 6 months of the decision.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending May 26, 2023 Indian Point Effluent Releases WebPage On May 19, 2023, staff published a new Indian Point FAQ public U.S. Nuclear Regulatory Commission (NRC) webpage on effluent releases. The new webpage provides responses to common public concerns and questions related to effluent releases and provides links to radioactive effluent and environmental reports for Indian Point Units 2 & 3. The NRC assembled this website to improve public awareness as well as reduce the required staff resources needed to respond to individual questions and concerns. Waste Control Specialist Non-Enforcement Order for the Possession of Special Nuclear Material On May 22, 2023, the NRC staff issued a non-enforcement order for the possession of special nuclear material (SNM) to Waste Control Specialists (WCS) (Agencywide Documents Access and Management System Accession No. ML22221A070). The order supersedes an existing order that grants WCS an exemption from Title 10 of the Code of Federal Regulations Part 70 requirements allowing possession of SNM greater than a critical mass aboveground at the WCS Site in Andrews County, Texas. The order also authorizes WCS to move the U.S. Department of Energy Los Alamos National Laboratory (LANL) Waste from the WCS Federal Waste Facility disposal cell to the enclosure in the WCS Treatment Storage and Disposal Facility, prepare the LANL waste for shipment in the enclosure, and to temporarily store the LANL waste in the enclosure.

Extravasations Rulemaking Public Meeting On May 24, 2023, the Office of Nuclear Material Safety and Safeguards staff held a public meeting to facilitate stakeholder feedback on the preliminary proposed rule language and questions included in the Federal Register notice (88 FR 24130) related to the rulemaking on reporting nuclear medicine injection extravasations as medical events. The meeting had over 200 attendees from the NRC, medical community, patient advocates, Agreement States, and the public. Feedback included questions on the definitions in the preliminary proposed rule language, availability of the dosimetry model for comment, the use of existing professional society and international standards to inform the rule and reducing patient self-reporting of extravasations. Staff will consider the comments on the Federal Register notice as they develop the proposed rule package.
