Office of Nuclear Reactor Regulation Items of Interest Week Ending April 21, 2023 SHINE TECHNOLOGIES, LLC Informed the U.S. Nuclear Regulatory Commission of Anticipated Delaying the Need of Operating License On April 20, 2023, SHINE Technologies LLC, (SHINE) informed the staff that they anticipate delaying the need for its operating license to the first quarter of calendar year 2025 for its Medical Isotope Production Facility based upon SHINEs revised construction schedule. SHINE plans on refining the schedule over the next few months considering construction priorities and available resources. Per Title 10 of the Code of Federal Regulations 50.57 Issuance of Operating License, an operating license may only be issued once construction of the facility has been substantially completed. The staff completed its safety evaluation and environmental review of the facility in February 2023.
The U.S. Nuclear Regulatory Commission presented at the Boiling Water Reactor/Pressurized Water Reactor Owners Group Risk Management Committee Meeting On April 19, 2023, the Office of Nuclear Reactor Regulation (NRR) staff participated in the joint Boiling Water Reactor/Pressurized Water Reactor Owners Group Risk Management Committee meeting. The staff delivered presentations on a wide variety of initiatives to highlight where staff are leveraging the be RiskSMART framework and risk-informed decision making, including several topics related to probabilistic risk assessment configuration control, risk-informed material assessment, as well as a summary of the staffs efforts underway in risk-informing evaluations of common cause failures in digital instrumentation and control systems (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23100A123). The staff also discussed its plans to conduct a public risk forum in late summer.
The meeting was well-attended and was successful in coordinating future risk-informed activities and sharing industry and U.S. Nuclear Regulatory Commission (NRC) staff insights.
NRC held Public Workshop on Inspection Procedure, Age-Related Degradation On April 18, 2023, NRR staff held a public workshop to discuss Inspection Procedure 71111.21N.04, Age-Related Degradation, (ARD). NRC staff discussion topics included the basis for inspecting ARDs, ARD inspection implementation, and lessons learned from the Environmental Qualifications and Power-Operated Valve inspections used to prepare for ARD inspection implementation. Representatives from the nuclear industry and the Nuclear Energy Institute provided feedback on their potential concerns with the inspection implementation. NRC staff addressed the concerns, which was well received by the industry representatives. The meeting announcement is located at ADAMS Accession No. ML23100A055.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending April 21, 2023 Reporting Nuclear Medicine Injection Extravasations as Medical Events: Preliminary Proposed Rule Language; Notice of Availability and Public Meeting; 10 CFR Part 35

On April 19, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 24130) making available preliminary proposed rule language for a rulemaking on the reporting of nuclear medicine injection extravasations as medical events. To inform this rulemaking, the NRC is posing questions to obtain input from stakeholders. The NRC will consider feedback on this notice in the development of a proposed rulemaking planned for publication in late 2024. The NRC will also hold a public meeting during the comment period on this notice to facilitate feedback. Comments are due by July 18, 2023.
Draft Regulatory Guide: Release of Patients Administered Radioactive Material; Draft Guide; Request for Comment; 10 CFR Part 35 [NRC-2023-0086]
On April 21, 2023, the NRC published a notice in the Federal Register (88 FR 24495) issuing for public comment a draft regulatory guide (DG), DG-8061, Release of Patients Administered Radioactive Material. This DG is proposed Revision 2 to Regulatory Guide 8.39 of the same name. This proposed revision provides licensees with methods that are acceptable to the NRC for the release of patients after a medical procedure involving implants that contain radioactive material. Comments are due by June 20, 2023.
