Office of Nuclear Reactor Regulation Items of Interest Week Ending April 14, 2023 U.S. Nuclear Regulatory Commission to Issue a Federal Register Notice on the National Institute of Standards and Technology National Bureau of Standards Test Reactor License Amendment Request On April 18, 2023, a no significant hazards consideration Federal Register notice and opportunity for comment (88 FR 23695) was published in response to a license amendment request (LAR) submitted by the National Institute of Standards and Technology (NIST) National Bureau of Standards Test Reactor. In preparation for installation of a new cold neutron source, NIST submitted a LAR for a new method of evaluation of a tritium dose from a hypothetical release of gaseous deuterium. The LAR is independent of the February 3, 2021, event and associated restart activities.

U.S. Nuclear Regulatory Commission Held a Public Meeting with the Nuclear Energy Institute Regulatory Issues Task Force On April 12, 2023, the U.S. Nuclear Regulatory Commission (NRC) held a hybrid public meeting with the Nuclear Energy Institute (NEI) Regulatory Issues Task Force to provide feedback on regulatory issues. Topics discussed included: potential license amendment request process improvements and streamlining, expectations for the pre-application meetings, update on risk-informed process for evaluations and risk assessment process for review of topical reports, next steps for risk-informed licensing, update on EMBARK activities, discussion on staffing, budgeting, and resources, and early feedback for the 2023 Regulatory Information Conference.

There were over 45 NRC, industry, and public attendees. The NRC presentation slides (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23097A015) and the NEI presentation slides (ML23100A105 and ML23100A088) are available in ADAMS.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending April 14, 2023 Office of Nuclear Material Safety and Safeguards Participation on the Council for the Alaska Micro-reactor Program During April 4-5, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff participated in several Department of Air Force (DAF) meetings in Fairbanks, AK, on the Council for the Alaska Micro-reactor Program. The Office of Nuclear Material Safety and Safeguards (NMSS) and the Office of Nuclear Reactor Regulation staff gave a brief presentation on the NRC and its reactor licensing process. Other speakers included the Department of Defense (DOD) Defense Logistics Agency, the Department of Energy (DOE), and the Commissioner of the Alaska Department of Environmental Conservation. Attendees included the Alaska Governors office, Alaska Department of Law, Alaska Center for Energy and Power, Fairbanks North Star Borough, DAF Civil Engineering Squadron, and representatives of Alaska Native groups. The NRC will continue coordination with DAF, DOD, DOE, the State of Alaska, Native Alaskans, and local governments on the DAFs micro-reactor program.

Public meeting on Decommissioning Trust Funds On April 13, 2023, NMSS staff held a public information meeting to discuss the NRCs position on the use of decommissioning trust funds for major radioactive component disposal during operations and provide examples of information that would be useful to NRC staff when considering an exemption request (Agencywide Documents Access and Management System Accession No. ML23095A095). The meeting was attended by approximately 89 registered participants. The staff plans to publish and request public comments on draft guidance in May 2023.
