Health and The Site was used for the disposal of Safety low-level radioactive wastes and miscellaneous laboratory and research wastes from the mid-1950s to the early 1960s. The Site is approximately 12 acres in size. Currently Environmental, Health, and Safety conducts semi-annual groundwater monitoring at the Site. On April 22, 1996, Ohio State University submitted a Letter of Intent to the NRC (Nuclear Regulatory Commission) for the Fawcett Site. I am requesting a copy of the Letter of Intent submitted to the NRC by Ohio State University from April 22, 1996. I am also requesting any records which indicate any agreement or instructions relating to groundwater monitoring at the Fawcett Landfill Site.

Items of Interest Week Ending March 3, 2023 Staff to Issue SHINE Safety Evaluation Report NRR plans to issue a safety evaluation report for the SHINE Medical Isotope Production Facility on February 27th. By letter dated July 17, 2019 (Agencywide Documents Access and Management System Accession No. ML19211C143), SHINE Technologies, LLC (SHINE) submitted an operating license application under Title 10 of the Code of Federal Regulations (10 CFR) Part 50 for eight subcritical irradiation units and a series of hot cell structures licensed as a non-power utilization and production facility, respectively. The purpose of the facility is to domestically produce medical isotopes, such as Mo-99. SHINE continues constructing the facility in Janesville, WI, and is estimating that the facility will be substantially complete by the second quarter of calendar year 2024. Issuance of the operating license will occur after the facility is substantially complete and the staff determines that SHINE meets the criteria in 10 CFR 50.57.
Issuance of Draft Regulatory Issue Summary 2014-06, Revision 1 for Comment On March 7, 2023, a Federal Register Notice was published (88 FR 14091) announcing the public comment period for the draft revision to regulatory issue summary (RIS) 2014-06, Consideration of Current Operating Issues and Licensing Actions in License Renewal. The RIS was revised to provide additional clarity on the operating experience and other technical information considered by the U.S. Nuclear Regulatory Commission (NRC) staff in the license renewal process to enable the NRC staff to make a determination that the license may be renewed.
NRC held Instrumentation and Controls Licensing Framework for Advanced Reactors Workshop On February 23, 2023, NRC staff held the first public workshop on the Instrumentation and Controls (I&C) Licensing Framework for Advanced Reactors. The workshops are part of the agencys efforts to streamline reviews of future license applications and to ensure common understanding amongst the NRC staff and potential applicants. This workshop covered the following topics: (1) Overview of the Licensing Modernization Project (LMP) and on-going activities under the NRC-led Advanced Reactor Content of Applications Project, (2) Overview of the I&C Design Review Guide (DRG), and (3) Discussion of industry perspectives and specific questions regarding LMP and DRG implementation. The workshop was well attended with over one hundred participants. The staff is planning for additional workshops to continue discussions on specific areas, including the use of alternative international I&C safety standards.
NRC held Public Meeting to Discuss Status of Staffs Review of the Limerick License Amendment Request regarding 10 CFR 50.69 License Conditions On February 23, 2023, the NRC held a hybrid public meeting (ML23053A199) with Constellation to discuss the staffs preliminary partial denial of Constellations amendment request to adopt alternate 10 CFR 50.69 methodologies for the Limerick plant. The staff intends to deny two of the three proposals (pressure boundary (PB) and defense-in-depth (DID) categorization processes) from Constellations request. NRC staff conveyed its intent to approve the seismic categorization proposal and discussed the bases for denying the PB and DID proposals (ML23053A156). Constellation, Electric Power Research Institute, and Pressurized Water Reactor Owners Group representatives provided their perspectives on the staffs conclusions on the PB and DID proposals. Consistent with LIC-101, the staff plans to issue a partial denial if the licensee does not withdraw the PB and DID proposals. The staff will engage with the industry on this topic if the industry pursues a future submittal.

Items of Interest Week Ending March 3, 2023 Release of Remaining Survey Units from the La Crosse Boiling Water Reactor Possession Only License and Termination of the 10 CFR Part 50 license On February 24th, the staff approved the release of the 16 remaining survey units from the La Crosse Boiling Water Reactor (LACBWR) Possession Only License (ML23055A027). This release effectively terminates the LACBWR Title 10 of the Code of Federal Regulations (10 CFR) Part 50 license outside of the remaining onsite independent spent fuel storage installation (ISFSI) footprint. The staffs intensive and comprehensive review used information provided by the licensee in the NRC-approved LACBWR License Termination Plan, as well as specific survey information from the associated LACBWR Final Status Survey Report. The completion of this action represents the culmination of the decommissioning work at the site undertaken by LaCrosse Solutions, LLC, which began after they received the LACBWR 10 CFR Part 50 license via license transfer in 2016. The license will now be transferred back to the original licensee (Dairyland Power Cooperative) who will operate and maintain the ISFSI until the fuel can be removed from the site and the ISFSI itself decommissioned.
Comanche Peak Nuclear Power Plant Public Meeting On February 23, 2023, staff from NMSS, the Office of Nuclear Reactor Regulation, the Office of Congressional Affairs, and Region IV conducted an in-person public meeting in Glen Rose, TX, regarding environmental scoping for the Comanche Peak Nuclear Power Plant (CPNPP) license renewal application. Approximately 48 people attended the meeting and 17 provided comments.
Local officials, residents, and media attended the meeting, as well as representatives from the labor union and non-governmental organizations. Comments were wide-ranging and included support for the CPNPP license renewal related to baseload energy production and local socioeconomic impacts to opposition to CPNPP citing concerns about radiological hazards such as accidents and spent nuclear fuel storage, and drought due to climate change.

On March 2, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 13017) confirming the effective date of March 22, 2023, for the direct final rule that was published in the Federal Register (88 FR 949) on January 6, 2023. This direct final rule amended the Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System listing in the List of approved spent fuel storage casks to include Amendment No. 6 to Certificate of Compliance No. 1032. The effective date of March 22, 2023, for the direct final rule published January 6, 2023, is confirmed.

Renewing Nuclear Power Plant Operating Licenses - Environmental Review: Proposed Rule; 10 CFR Part 51 [NRC-2018-0296; RIN 3150-AK32]
On March 3, 2023, the NRC published a notice in the Federal Register (88 FR 13329) proposing to amend its environmental protection regulations by updating the Commissions 2013 findings on the environmental effect of renewing the operating license of a nuclear power plant. The NRC proposes to redefine the number and scope of the environmental issues that must be addressed during the review of each application for license renewal. As part of this update, the NRC has prepared draft Revision 2 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants (LR GEIS), to account for new information and to address the impacts of initial license renewals, which the previous versions considered, as well as first subsequent license renewals. The draft revised LR GEIS provides the technical basis for this proposed rule. The NRC is providing an opportunity for interested parties to submit comments on this proposed rule, the draft revised LR GEIS, and associated draft guidance.
Comments are requested by May 9, 2023.
Revision of Fee Schedules; Fee Recovery for Fiscal Year 2023: Proposed Rule; 10 CFR Parts 170 and 171 [NRC-2021-0024; RIN 3150-AK58]
On March 3, 2023, the NRC published a notice in the Federal Register (88 FR 13357) proposing to amend the licensing, inspection, special project, and annual fees charged to its applicants and licensees. The proposed amendments are necessary to comply with the Nuclear Energy Innovation and Modernization Act, which requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee-recovery requirement. Comments are requested by April 3, 2023.

Items of Interest Week Ending March 3, 2023 Public Release of Case File for DPO-2021-002 On February 6, 2023, the Executive Director for Operations (EDO) issued a decision on the appeal of a Differing Professional Opinion (DPO) submitted on September 27, 2021. The DPO raised concerns related to changes to the composition of the licensed operator initial exam as issued in NUREG-1021, Revision 12. The EDOs decision on the DPO appeal concluded that the methodology and logic for reintegrating the Generic Fundamentals Exam (GFE) into the Reactor Operator written examination specified in NUREG-1021, Revision 12, are acceptable.
However, the EDO directed the Office of Nuclear Reactor Regulation to revise the Effectiveness Review Plan for NUREG-2021, Revision 12 to: 1) have sufficient duration to ensure that meaningful data is collected for generic fundamentals questions from applications who had NOT previously taken a standalone NRC GFE; 2) include guidance to review any questions that may indirectly/implicitly test generic fundamentals and were incorrectly answered and include that data in the effectiveness review; and 3) contain specific thresholds for performance that will trigger revisiting the sample plan distribution contained in NUREG-1021, Revision 12. The purpose of this contract is to acquire commercial webcasting and captioning services to the general public and stakeholders with real-time and archived access to U.S. Nuclear Regulatory Commission (NRC) public meetings via the NRCs streaming webpage. The period of performance is from March 1, 2023, through February 29, 2024, with four option periods. The total potential value of the contract can be up to $3,390,959.93.
