Office of Nuclear Reactor Regulation Items of Interest Week Ending May 19, 2023 The U.S. Nuclear Regulatory Commission Holds Quarterly Meeting with Industry-Led Technical Specifications Task Force On May 11, 2023, the Office of Nuclear Reactor Regulation staff and the industry-led Technical Specifications Task Force (TSTF) conducted a regularly scheduled quarterly meeting (Agencywide Documents Access and Management System Accession No. ML23117A351).

Discussions included on-going activities, and some newly introduced initiatives by the TSFT.

The TSTF prioritized the travelers under review to aid the U.S. Nuclear Regulatory Commission (NRC) in more efficient use of staffing resources. The next TSTF quarterly meeting will take place in August 2023.

NRC Issues Latest Understanding of Seismic Hazards at Vogtle Units 1, 2, and 3 Following the Process for the Ongoing Assessment of Natural Hazards Information On May 15, 2023, the NRC staff issued its latest understanding of seismic hazards at the Vogtle Electric Generating Plant (Vogtle), Units 1, 2, and 3 (ML23006A091), following the process for the ongoing assessment of natural hazards information. The NRC staff assessment considers new seismic ground motion attenuation models for central and eastern North America and updated seismic site response methods. Based on its evaluation of updated seismic hazard curves for the Vogtle plant site, using the new ground motion models and updated site response methods, the NRC staff determined that no further regulatory evaluation of the Vogtle, Units 1, 2, and 3, plant seismic risk is warranted at this time. Vogtle, Unit 4, was not included in the regulatory evaluation as the unit is currently under construction. This is the first of more than a dozen seismic hazard evaluation reports the NRC expects to issue in 2023.

NRC Issues Partial Approval and Denial of Constellations Request to Use Three Alternative 10 CFR 50.69 Methods at the Limerick Plant On May 17, 2023, the NRC staff issued a partial approval and denial (ML23090A163) of Constellation Energy Generation, LLCs (Constellation or Licensee) amendment request to use three alternative Title 10 of the Code of Federal Regulations (10 CFR) Part 50.69 methods for categorizing systems, structures, and components (SSCs) at the Limerick plant. The NRC staff approved Constellations request to use an alternative seismic approach for categorizing SSCs in the licensees application of 10 CFR 50.69 but denied Constellations request to use alternative defense-in-depth and pressure boundary SSC categorization processes.

NRC Signs Order Approving an Indirect License Transfer for the Susquehanna Station, Units 1 and 2, and the Associated Independent Spent Fuel Storage Installation On March 30, 2023, the NRC staff signed an order (ML23073A126) approving an indirect license transfer for the Susquehanna Steam Electric Station, Units 1 and 2, and the associated independent spent fuel storage installation. The NRCs order supported the proposed transaction in which Susquehanna Nuclear would continue to be directly owned by Talen Energy Supply, but which, in turn, would be directly owned by a new parent company (now JUNE 7, 2023 ENCLOSURE C

called Talen Energy Corporation). On May 17, 2023, Susquehanna Nuclear informed the NRC that it completed its license transfer and emergence from bankruptcy (ML23137A314), and the NRC staff issued the conforming license amendments for the license transfer (ML23132A321).

NRC Hosted a Public Meeting Related to the Reactor Oversight Process On May 18, 2023, the NRC staff hosted a public meeting related to the Reactor Oversight Process (ROP) to discuss: calendar year 2023 ROP self-assessment activities, an update on the Age-Related Degradation inspection procedure implementation, plans for revising the Problem Identification and Resolution inspection procedure (ML23136A589), and a draft response to a public inquiry on Part 26 requirements to contractor travel time (ML23131A397).

Industry representatives presented several topics including: Frequently Asked Question 23-02 relating to an interpretation of a performance indicator at Peach Bottom, an update on the upcoming revision to Nuclear Energy Institute 99-02, and a follow-up discussion on potential changes to the safety culture inspection and assessment program (ML23136A591). Attendees included the industrys Reactor Oversight Process Task Force, NextEra Energy, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for July 13, 2023.

X-energy Submits Letter of Intent Informing the NRC that Dow and X-energy Intend to Submit a 10 CFR Part 50 Construction Permit Application and Operating License Application for a 4-Unit Xe-100 Nuclear Power Facility in Calhoun County, Texas On May 17, 2023, X Energy, LLC (X-energy) submitted a letter of intent (ML23138A328) informing the NRC that Dow Chemical Company (Dow) and X-energy intend to submit a 10 CFR Part 50 Construction Permit application and subsequent Operating License application for a 4-unit Xe-100 nuclear power facility at the Dow Seadrift site in Calhoun County, Texas. The letter states that the team is considering the opportunity to conduct a preapplication readiness assessment with the NRC in advance of the docketed submission. The NRC staff will continue to engage with X-energy and Dow in preapplication to support the companys planned applications.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending May 19, 2023 Abnormal Occurrences Report: Proposed Limited Revision to Policy Statement; 10 CFR Chapter I (NRC-2023-0075)

On May 19, 2023, the U.S Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 32145) proposing limited revisions to its policy statement on reporting abnormal occurrences to Congress. The proposed revisions are to the medical event criteria for determining events that are significant from the standpoint of public health or safety. Comments are requested by August 17, 2023.

Westinghouse Transfer of Control of License On May 15, 2023, NRC staff issued an Order (Agencywide Documents Access and Management System Accession No. ML23096A266) approving the indirect transfer of control of licenses for Westinghouse Electric Company, LLC. The Order includes the special nuclear materials license, SNM-1107, and thirty-four export licenses. The December 20, 2022, submission sought consent of the proposed indirect transfer of control of certain materials and export licenses to Brookfield Corporation (Brookfield Renewable Partners L.P. and Cameco Corporation as partners in the transaction).

Public Meeting on the Integrated Low-Level Radioactive Waste Disposal Rulemaking On May 17, 2023, the Office of Nuclear Material Safety and Safeguards staff held a virtual public meeting on the integrated low level radioactive waste disposal rulemaking.

Approximately, 60 members of the public attended the meeting, including representatives from state governments, industry, the Department of Energy, and the Government Accountability Office. The staff discussed preliminary direction on topics being addressed in this rulemaking and provided the public an opportunity to ask questions. The staff is developing a proposed rule currently scheduled to be submitted to the Commission in November 2023.
