Office of Nuclear Reactor Regulation Items of Interest Week Ending October 27, 2023 Draft Revision 9 to Branch Technical Position (BTP) 7-19, Guidance for Evaluation of Defense in Depth and Diversity to Address Common-Cause Failure Due to Latent Design Defects in Digital Safety Systems, Published for Public Comment On October 24, 2023, the draft Revision 9 to Branch Technical Position (BTP) 7-19, Guidance for Evaluation of Defense in Depth and Diversity to Address Common-Cause Failure Due to Latent Design Defects in Digital Safety Systems (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23222A237 and ML23222A219) was published for 30-day public comment in the Federal Register (88 FR 73051). The BTP, which is part of the standard review plan for light-water reactors, provides the U.S. Nuclear Regulatory Commission (NRC) staff with review guidance for evaluating an applicants assessment of the adequacy of defense in depth and diversity for a proposed digital instrumentation and control system. The revisions update the guidance to incorporate the expanded policy described in SRM-SECY-22-0076 (ML23145A181 and ML23145A182). Prior to the end of the comment period, the NRC staff plans to hold a public meeting with external stakeholders on November 14, 2023, (ML23296A080) to provide an opportunity for them to ask the NRC staff questions about the revisions to the review guidance.

On October 27, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 42654) extending the comment period for the rulemaking that was published on July 3, 2023 (88 FR 42654). The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments. The due date for comments requested in the document published on July 3, 2023, is extended.

Comments are requested by December 15, 2023.
