Items of Interest Week Ending February 17, 2023 NRC Staff Issues Revision No. 16 of the Certificate of Compliance No. 9330 to DOE for the Model No. ATR-FFSC Package On February 10, 2023, the staff issued Revision No. 16 of the Certificate of Compliance No.

9330 to the Department of Energy (DOE) for the Model NO. ATR-FFSC Package (Agencywide Documents Access and Management System Accession No. ML23033A522). DOE requested an increase of the payload weight limits for the Advanced Test Reactor Low Enriched Uranium (LEU) and Missouri University Research Reactor LEU fuel element configurations, an increase of the maximum package weight for all configurations, and an increase of the maximum fissile mass for the COBRA LEU fuel element configuration.

List of Approved Spent Fuel Storage Casks: HI-STORM 100 Cask System, Certificate of Compliance No. 1014, Renewal of Initial Certificate and Amendment Nos. 1 through 15; 10 CFR Part 72; Direct Final Rule [NRC-2022-0109; RIN 3150-AK86]

On February 13, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 9106) amending its spent fuel storage regulations by revising the Holtec International HI-STORM 100 Cask System listing within the List of approved spent fuel storage casks to renew, for 40 years, the initial certificate and Amendment Nos. 1 through 15 of Certificate of Compliance No. 1014. The renewal of the initial certificate and Amendment Nos. 1 through 15 revises the certificate of compliances conditions and technical specifications to address aging management activities related to the structures, systems, and components important to safety of the dry storage system to ensure that these will maintain their intended functions during the period of extended storage operations. The companion proposed rule was also published in the Federal Register on February 13, 2023 (88 FR 9195). This direct final rule is effective May 1, 2023.

Qualification of Connection Assemblies for Production and Utilization Facilities:

Regulatory Guide; Issuance; 10 CFR Parts 50 and 52 [NRC-2022-0083]

On February 13, 2023, the NRC published a notice in the Federal Register (88 FR 9105) issuing Revision 2 of Regulatory Guide (RG) 1.156, Qualification of Connection Assemblies for Production and Utilization Facilities. This revised guide was updated to endorse Institute of Electrical and Electronics Engineers Std. 572-2019 to provide the latest technical information on approaches to satisfy the qualification requirements for connection assemblies. This includes guidance that when used in conjunction with the guidance in RG 1.89, Environmental Qualification of Certain Electric Equipment Important to Safety for Nuclear Power Plants, provides an acceptable method of demonstrating compliance with the NRC regulations pertaining to the environmental qualification of connectors, terminations, and environmental seals in combination with cables or wires as assemblies for service in production and utilization facilities to ensure that the connection assemblies can perform their safety functions. Further, the revised guide modifies the title of the RG to include other nuclear facilities, as discussed in the RG Section A, under Applicability. Revision 2 of RG 1.156 is available on February 13, 2023.

Cyber Security Programs for Nuclear Power Reactors: Regulatory Guide; Issuance; 10 CFR Part 73 [NRC-2021-0143]

On February 13, 2023, the NRC published a notice in the Federal Register (88 FR 9117) issuing Revision 1 to RG 5.71, Cyber Security Programs for Nuclear Power Reactors. Revision 1 incorporates references to industry guidance on identifying and protecting critical digital assets for safety-related, important to safety, balance of plant, and emergency preparedness equipment. It also clarifies guidance on defense-in-depth for cyber security and includes updated text based on the latest National Institute of Standards and Technology (NIST) and International Atomic Energy Agency cyber security guidance. This revision also considers the changes in the most recent revision to the NIST Special Publications 800-53, upon which Revision 0 of RG 5.71, Cyber Security Programs for Nuclear Facilities was based. Revision 1 to RG 5.71 is available on February 13, 2023.

NRC Hosts Public Meeting to Discuss Integrated Materials Performance Evaluation Program Processes and Effectiveness On February 14, 2023, NRC staff held a virtual public meeting to aid an ongoing working group assessment of the ability to monitor trends in National Materials Program performance. The purpose of this meeting was to discuss current Integrated Materials Performance Evaluation Program processes and ways in which the program could be more effective. The meeting was well attended by approximately 60 Agreement State and NRC staff. A second public meeting for discussion of this topic will be held on February 23.

NRC Issues Record of Decision and License Amendment to Allow Disposal of Uranium Mine Waste at United Nuclear Corporation Mill Site in New Mexico On February 15, 2023, the staff issued the Record of Decision and License Amendment 58 (ML23023A118), to the United Nuclear Corporation Mill (UNC), License Number SUA-1475, granting the UNCs amendment request, dated September 24, 2018. The amendment request was for approval for construction of a repository to allow for disposal of mine-impacted soil and debris from the adjacent Northeast Church Rock Mine Site onto the existing NRC licensed mill tailings disposal area in McKinley County, NM. In addition, this license amendment revises the reclamation plan for the site to improve erosion protection.
