Office of Nuclear Reactor Regulation Items of Interest Week Ending May 12, 2023 NRC Hosts Public Meeting on Diablo Canyon License Renewal Process On May 3, 2023, the U.S. Nuclear Regulatory Commission (NRC) hosted a hybrid public meeting in the vicinity of the Diablo Canyon Nuclear Power Plant (DCPP) in San Luis Obispo, California, to present the end of cycle assessment and an overview of the license renewal process. Approximately 100 attendees participated in-person, including Rep. Carbajal, and 130 attendees virtually via Teams. Comments focused on seismic concerns and spent fuel storage considerations at DCPP. However, numerous comments were also supportive of the plant continuing operation and renewing the operating licenses, which will expire in 2024 (Unit 1) and 2025 (Unit 2). The staff was able to address the questions raised during the meeting. Prior to the public meeting, the staff held three meetings: a general government to government meeting, a meeting with the Northern Chumash Tribe, and a meeting with Rep. Carbajal and his staffers.
NRC Issues Severity Level III Violation to the University of Texas at Austin On May 10, 2023, the staff issued a Severity Level III violation to the University of Texas at Austin. The violation involves operating the research reactor, from January 6, 2022, to October 17, 2022, with fuel elements that did not meet the technical specification (TS) requirements.
Specifically, the licensee utilized two aluminum-cladded TRIGA (Training, Research, Isotopes, General Atomics) fuel elements in the reactor core contrary to TS 5.3.1, which states, in part, that fuel element cladding will be 304 stainless steel, nominal 0.020 inches thick. Following the incident, the licensee identified the root cause for the violation and implemented corrective actions. The staff has completed its inspection of the licensees actions.
NRC Finalizes Regulatory Issue Summary, Preparation and Scheduling of Operator Licensing Examinations On May 9, 2023, the NRC finalized the Regulatory Issue Summary entitled, Preparation and Scheduling of Operator Licensing Examinations, (Agencywide Documents Access and Management System Accession No. ML23025A219), to inform addressees that the NRC staff needs updated information on projected site-specific operator licensing examination schedules and on the estimated number of applicants planning to take operator licensing examinations.
NRC Briefs the National Academies of Sciences, Engineering, and Medicine Committee that is Conducting a Consensus Study on U.S. Coast Guards Constraints and Challenges in Ensuring that its Certificate of Compliance Examination Program for Gas Carriers is Designed and Carried Out Efficiently and Effectively On May 9, 2023, the Director of the Division of Risk Assessment, Office of Nuclear Reactor Regulation (NRR) briefed the National Academies of Sciences, Engineering, and Medicine committee that is conducting a consensus study of the constraints and challenges faced by the U.S. Coast Guard (USCG) in ensuring that its certificate of compliance (COC) examination program for gas carriers is designed and carried out efficiently and effectively. The USCG COC program includes examinations and inspections of liquefied gas (e.g., natural or petroleum gases) carrier safety, security, and environmental requirements. Per the National Academies committees request, the NRC staff presented on the application of risk informed decision making (RIDM) and use of probabilistic risk assessment (PRA) technology in the NRCs MAY 19, 2023 ENCLOSURE B
oversight and inspection of reactors. Topics included NRCs evolutionary use of PRA and RIDM in the agencys work, the Reactor Oversight Process and incident investigation framework, related infrastructure (people, risk tools, and guidance), and treatment of emergent safety issues (LIC-504 process) including use of enterprise risk management and the BeRiskSMART initiative.
NRC Hosts Public Meeting on Accident Tolerant Fuel Roadmap to Readiness Graphic On May 10, 2023, NRR staff held a hybrid, comment-gathering public meeting to discuss the Accident Tolerant Fuel (ATF) Roadmap to Readiness graphic. The meeting had over 50 attendees. This meeting provided an opportunity for industry and stakeholders to submit feedback on the ATF roadmap content, appearance, and underlying assumptions before publication on NRCs ATF public website. NRC staff facilitated a discussion with stakeholders, which included the Department of Energy (DOE), Nuclear Energy Institute, Framatome, and others. Staff will consider the feedback as they develop the final version of the roadmap.
X-Energy and Dow Announce that Dow has Selected its Seadrift Operations Site in Texas as the Location for Four Units of X-energys Xe-100 High Temperature Gas Reactor On May 11, 2023, X Energy, LLC (X-energy) and Dow, Inc. (Dow) announced that Dow has selected its Seadrift Operations site in Texas as the location for four units of X-energys Xe-100 high temperature gas reactor. Dow stated that the project is focused on providing the chemical manufacturing site with zero carbon emissions power and steam. The DOE previously named Dow as a sub-awardee under X-energy's Advanced Reactor Demonstration Program (ARDP)
Cooperative Agreement with half of the project funding eligible for reimbursement through ARDP. Dow and X-energy are preparing to submit a Construction Permit application (CPA) to the NRC to support construction in 2026. More details regarding the CPA are expected when X-energy and Dow submit a future letter of intent.
NRC Holds Closed Meeting with Framatome to Discuss a Planned White Paper on Fuel Fragmentation, Relocation, and Dispersal in Support of a Future Increased Burnup Topical Report On May 9, 2023, the NRC staff held a closed hybrid meeting with Framatome Inc. (Framatome) to discuss a planned white paper on fuel fragmentation, relocation, and dispersal which will support a future increased burnup topical report. An overview of the white paper topics was provided by Framatome, and the staff discussed the submittal and white paper process.
Framatome also provided clarification on the planned submittal date, desired outcome, and the type of feedback that would be requested. Framatome plans to notify the staff on whether they will request an additional pre-submittal meeting. The staff will prepare a non-proprietary meeting summary.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending May 12, 2023 Letter from the New York Governor On May 9, 2023, the New York State Governor, Kathy Hochul, signed a letter notifying the U.S.
Nuclear Regulatory Commission (NRC) of their intent to return the New York State Sealed Source Devices Evaluation program back to the NRC with an effective date of June 12, 2023.
NRC staff will use the process outlined in SRM-SECY-95-136 Options to Improve and Standardize the Evaluation and Approval of Sealed Sources and Devices Manufactured in Agreement States to develop a SECY Paper recommending that the NRC assume regulatory authority over this activity.
Holtec International On May 9, 2023, staff issued Materials License No. SNM-2516 to Holtec International (Holtec)
(ML23075A179) for construction and operation of the HI-STORE Consolidated Interim Storage Facility, to be located in Lea County, New Mexico. The license authorizes Holtec to store up to 8,680 MTU (500 canisters) of commercial spent nuclear fuel in the HI-STORM UMAX Canister Storage System. In conjunction with the license, the staff also issued a final Safety Evaluation Report documenting its compliance findings, and a Record of Decision for the environmental review.
