Items of Interest Week Ending March 31, 2023 The U.S. Nuclear Regulatory Commission (NRC) Held a Public Workshop Related to Probabilistic Risk Assessment Configuration Control On March 30, 2023, NRR staff held a public workshop to gather feedback on proposed recommendations and path forward related to developing a balanced approach to oversight of probabilistic risk assessment configuration control (PRA CC) (Agencywide Documents Access and Management System Accession No. ML23067A422). The meeting was well-attended by over 100 attendees from industry, including the Nuclear Energy Institute, NextEra, Entergy, and members of the public. Industry provided feedback on the timing/frequency of the enhanced oversight activities to align with the plants PRA updates to optimize the staffs oversight efforts of PRA CC. Staff will consider the industrys feedback to support its development of recommendations for future inspections in this area.

NRC Supported Government-to-Government Meeting on the Safety and Environmental Review Process for the Proposed TerraPower Natrium Reactor Demonstration Project On March 29, 2023, NRC staff supported a government-to-government meeting with State officials from the Wyoming Department of Environmental Quality and policy advisors to the governor of Wyoming. Staff from the Department of Energy (DOE) Office of Clean Energy Demonstrations also participated in the meeting. The purpose of the meeting was for the NRC and DOE to provide an overview of the processes that will be used to conduct safety and environmental reviews of TerraPowers proposed Natrium demonstration reactor project in Kemmerer, WY. The State officials requested a follow-up meeting with the NRC and DOE for late July 2023 to provide a similar overview of the safety and environmental review processes for state legislators.

NRC Exceeds 18-month Nuclear Energy Innovation and Modernization Act Generic Milestone for the St. Lucie Subsequent License Renewal Application Final Safety Evaluation On March 27, 2023, the staff exceeded the 18-month Nuclear Energy Innovation and Modernization Act generic milestone established for issuance of the final safety evaluation for the Florida Power & Light Company (FPL) subsequent license renewal application (SLRA) for the St. Lucie Plant, Units 1 and 2. The St. Lucie SLRA was submitted by letter dated August 3, 2021 (ML21215A314), and accepted by the staff on September 24, 2021 (ML21246A090). On November 18, 2022 (ML22322A037), the staff issued a letter informing FPL that a revised review schedule for the St. Lucie SLRA will be issued once additional information is received to address the technical issues.

On March 29, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 18379) correcting a final rule that was published in the Federal Register on March 14, 2023 (88 FR 15864), regarding its regulations to implement its authority under Section 161A of the Atomic Energy Act of 1954, as amended. This action is necessary to correct an amendatory instruction, update the section-by-section analysis, and correct a grammatical error. The correction was effective on April 1, 2023.

Maintenance, Testing, and Replacement of Vented Lead-Acid Storage Batteries for Production and Utilization Facilities; Regulatory Guide: Final Guide; Issuance; 10 CFR Part 50 (NRC-2020-0159)

On March 27, 2023, the NRC published in the Federal Register (88 FR 18005) a notice issuing Revision 4 of Regulatory Guide (RG) 1.129, Maintenance, Testing, and Replacement of Vented Lead-Acid Storage Batteries for Production and Utilization Facilities. This revised guidance provides information to manage vented lead-acid battery degradation such that a battery in service would retain its readiness for supporting design-basis events. It endorses, with certain clarifying regulatory positions, Institute of Electrical and Electronics Engineers Standard 450-2020, which provides the recommended maintenance, test schedules, and testing procedures intended to optimize the life and performance of permanently installed vented lead-acid storage batteries used for standby power applications. It also provides guidance to determine when batteries should be replaced. Revision 4 to RG 1.129 was available on March 27, 2023.

Certificate of Compliance No. 9388 for the Model DN30-X Package to ORANO NCS GmbH (Germany)

On March 27, 2023, staff issued Revision No. 0 of the Certificate of Compliance No. 9388 for the Model DN30-X Package to ORANO NCS GmbH (Germany) (Agencywide Documents Access and Management System Accession No. ML23083B977). The Model No. DN30-X package consists of the DN30 protective structural packaging, approved under Docket No. 71-9362 for the Model No. DN30 package, and the 30B-X cylinder. This model will be used for shipment of uranium hexafluoride (UF6) with an enrichment up to 20 percent, making this a first of a kind packaging. The content includes high assay low enriched uranium enriched fuel from commercial natural UF6.

Public Meeting on the Proposed Rule - Renewing Nuclear Power Plant Operating Licenses - Environmental Review On March 28, 2023, NRC staff held a hybrid public meeting on the Proposed Rule - Renewing Nuclear Power Plant Operating Licenses - Environmental Review (88 FR 13329). The meeting was held in Naperville, IL. There were 29 members of the public in attendance; 5 attended in person and 24 joined the meeting remotely.

The staff discussed the proposed rule to facilitate submissions of public comments. The staff is planning to hold additional hybrid meetings in March and April in various locations around the country. The public comment period on the proposed rule ends on May 3.

Environmental Scoping Webinar for the Monticello Nuclear Generating Plant On March 29, 2023, the NRC conducted an environmental scoping webinar for the Monticello Nuclear Generating Plant, Unit 1, subsequent license renewal application. This meeting followed an in-person open house and scoping meeting held near Monticello, MN, on March 22.

In the opening remarks, NRC Region III staff addressed the recent tritiated water leak at Monticello, assuring the safety of the public, their drinking water, and the environment.

Approximately 10 members of the public and several Xcel representatives attended the scoping webinar. The Office of Nuclear Reactor Regulation and NMSS staff discussed the safety and environmental reviews and then opened the meeting up to scoping process questions and public comment.

2023 Integrated Materials Performance Evaluation Program During March 27-28, 2023, the State Agreement and Liaison Programs Branch (SLPB) hosted the 2023 Integrated Materials Performance Evaluation Program (IMPEP) Team Leader training.

SLPB provided this training to 10 team leaders, 8 team leaders in training, and 4 team leaders in training candidates. The prospective Team Leaders included two representatives from Agreement States (Oklahoma and Tennessee). Thirteen presenters made 16 presentations related to IMPEP and the National Materials Program, including tools, best practices, increased consistency, and senior management highlights.

The meeting was held in Westlake, TX. There were 29 members of the public in attendance; 6 attended in person and 23 joined remotely. The staff discussed the proposed rule to facilitate submissions of public comments. The staff is planning to hold additional hybrid meetings in April at various locations around the country. The public comment period on the proposed rule ends on May 3.

Response to the Natural Resources Defense Council and Other Organizations Regarding Request to Extend the Comment Period for the Proposed Rule, Renewing Nuclear Power Plant Operating Licenses - Environmental Review On March 30, 2023 NRC staff issued a letter responding to a request from the Natural Resources Defense Council and other organizations (ML23075A106), to extend the comment period for the proposed rule, Renewing Nuclear Power Plant Operating Licenses -

Environmental Review (Docket ID NRC-2018-0296). The NRC has denied the request; the public comment period will close, as announced in the Federal Register (88 FR 14958), on May 2.

Items of Interest Week Ending March 31, 2023 Charter Contract for the Operation of the Center for Nuclear Waste Regulatory Analyses as the NRCs Federally Funded Research and Development Center (FFRDC)

On March 29, 2023, contract number 31310023D0004 was awarded to Southwest Research Institute in San Antonio, TX. The purpose of this contract is to acquire the necessary personnel, materials, equipment, facilities, and other services to conduct technical assistance and regulatory analysis support for U.S. Nuclear Regulatory Commission in support of its regulatory program. The period of performance is from March 30, 2023, through March 29, 2024, with four option periods. The total potential value of the contract can be up to $10,618,867.00.
