Office of Nuclear Reactor Regulation Items of Interest Week Ending September 29, 2023 Dow Chemical Company and X-Energy Request New Project-Specific Docket for Project Long Mott On September 22, 2023, the Dow Chemical Company (Dow) and X-energy requested a new project-specific docket for Project Long Mott to support its site-specific licensing activities for the Xe-100 reactor deployment at the Dow site in Seadrift, TX. They indicated that a project company is currently being formed that will apply for the construction permit in 2024 and that X-energy will manage associated licensing activities on behalf of the project company.

NRC Staff Accepts Application for License Renewal of Perry Nuclear Power Plant, Unit 1 On September 22, 2023, the staff accepted an initial license renewal application from Energy Harbor Nuclear Corp, acting on its own behalf and for Energy Harbor Nuclear Generation LLC, requesting an additional 20 years for the renewed operating license of Perry Nuclear Power Plant (PNPP), Unit 1 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML23256A359). If approved for initial license renewal, PNPP will extend its license to November 7, 2046. The review is scheduled for 23 months with an estimated total of 20,000 hours0 days <br />0 hours <br />0 weeks <br />0 months <br />.

NRC Staff Issued Information Notice 2023-04: Operating Experience Related to Fire Events at Decommissioning Nuclear Power Plants in the United States On September 27, 2023, the U.S. Nuclear Regulatory Commission (NRC) finalized the Information Notice 2023-04: Operating Experience Related to Fire Events at Decommissioning Nuclear Power Plants in the United States (ML23088A143). The purpose is to inform addressees of fire events in radiologically controlled areas; posted radiologically contaminated areas; and instances of failure to control combustible material and/or perform adequate fire watch at decommissioning power reactor sites.

Holtec Decommissioning International, LLC Submitted an Exemption Request as Part of Proposed Regulatory Path to Restart Palisades Nuclear Plant On September 28, 2023, Holtec Decommissioning International, LLC (HDI), submitted a request for exemption of the requirements from 10 CFR 50.82(a)(2) as part of its proposed regulatory path to restart Palisades Nuclear Plant (ML23271A140). Specifically, HDI is requesting an exemption from the 10 CFR 50.82(a)(2) restriction that prohibits reactor power operations and retention of fuel in the reactor vessel. Palisades docketed its 10 CFR 50.82(a)(1) certifications on June 13, 2022. Holtec has previously indicated to the NRC staff that this exemption is part of several licensing actions it intends to request in order to enable the restart of Palisades Nuclear Plant.

NRC Staff Signed Order Approving the Indirect Transfer of Control of the Comanche Peak Nuclear Power Plant, Units 1 and 2 On September 28, 2023, the NRC staff signed an order (ML23237B427) approving the indirect transfer of control of the Comanche Peak Nuclear Power Plant, Unit Nos. 1 and 2, respectively, and its generally licensed independent spent fuel storage installation (ISFSI), and the direct and indirect transfer of control of the following licenses and their respective generally licensed ISFSIs (collectively, the Licenses): Beaver Valley Power Station, Unit Nos. 1 and 2; Davis-Besse Nuclear Power Station, Unit No. 1; Perry Nuclear Power Plant, Unit No. 1. Specifically, the application requested that the NRC consent to the license transfers resulting from a proposed transaction, as further described in a Transaction Agreement, pursuant to which VistraOps will indirectly acquire Energy Harbor Corp. and its subsidiaries and will restructure the upstream ownership of Comanche Peak. As part of the proposed transaction, Energy Harbor Nuclear Corp. and Energy Harbor Nuclear Generation LLC parent, Energy Harbor Corp., will become an indirect subsidiary of VistraOps via merger. Conforming amendments will be issued when the transfer occurs.
