Office of Nuclear Reactor Regulation Items of Interest Week Ending May 5, 2023 ARC Clean Technology Submits Regulatory Engagement Plan for ARC-100 Design On April 27, 2023, ARC Clean Technology (ARC) submitted an updated Regulatory Engagement Plan (REP) for its ARC-100 design (Agencywide Documents Access and Management System Accession No. ML23120A001), a 100 MWe (286 MWt), metal fueled, low pressure pool type, sodium cooled fast reactor. The REP describes preapplication engagement activities, including white paper and topical report submittals, that ARC intends to undertake through calendar year 2025. ARC has not yet decided on the timing or type of future license applications. In 2020, ARC was awarded $27.5M from the Department of Energy to support development of the ARC-100 as part of the Advanced Reactor Demonstration Program.

U.S. Nuclear Regulatory Commission Hosts Periodic Advanced Reactor Stakeholder Meeting On April 26, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held a hybrid meeting with over 150 stakeholders on advanced reactor regulatory topics. Areas of discussion included insights from the Nuclear Innovation Alliance workshop on improving advanced reactor licensing efficiency; advanced reactor licensing review enhancements; guidance for reviewing facility training programs; NRC engagement with tribal nations; alternative approaches to address population-related siting considerations; the joint NRC/Canadian Nuclear Safety Commission (CNSC) report on TRISO fuel qualification; and the CNSC-NRC memorandum of cooperation topic of safety classification of structures, systems, and components.

Meeting with Framatome to Discuss Topical Report On May 4, 2023, the NRC staff held a partially closed hybrid meeting with Framatome Inc. to discuss topical report ANP-10339P, Revision 0, ARITA - ARTEMIS/RELAP Integrated Transient Analysis Methodology, draft safety evaluation limitations and conditions and rescheduling the Advisory Committee on Reactor Safeguards subcommittee meeting. During the discussions, Framatome confirmed its request (ML23117A241) to delay the May 19, 2023, subcommittee meeting with a preferred date of late June or July 2023, but not further than October 2023, to resolve clarifications needed in the draft safety evaluation. The staff will prepare a non-proprietary meeting summary.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending May 5, 2023 Regulatory Guide: Environmental Qualification of Certain Electric Equipment Important to Safety for Nuclear Power Plants; Final Guide; Issuance; 10 CFR Parts 50 and 52 [NRC-2020-0245]

On May 3, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 27692) issuing Revision 2 to Regulatory Guide (RG) 1.89, Environmental Qualification of Certain Electric Equipment Important to Safety for Nuclear Power Plants. RG 1.89, Revision 2, provides guidance that the staff of the NRC considers acceptable to meet regulatory requirements for environmental qualification of certain electric equipment important to safety. Revision 2 to RG 1.89 was available on May 3, 2023.

American Society of Mechanical Engineers Code Cases and Update Frequency:

Proposed Rule; Extension of Comment Period; 10 CFR Part 50 [NRC-2018-0291; RIN 3150-AK23]

On May 3, 2023, the NRC published a notice in the Federal Register (88 FR 27712) extending the comment period for a proposed rule that was published on March 6, 2023, (88 FR 13717).

The proposed rule solicited comments on proposed amendments to its regulations to incorporate by reference proposed revisions to three regulatory guides, which would approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers. In addition, the rulemaking proposed to extend the time periods required for licensees to update their codes of record. The public comment period was originally scheduled to close on May 5, 2023. The NRC decided to extend the public comment period by an additional 42 days to June 16, 2023, to allow more time for members of the public to develop and submit their comments.

Draft Regulatory Guide: Quality Assurance Program Criteria (Design and Construction; Draft Guide; Request for Comment; 10 CFR Parts 50 and 52 [NRC-2023-0054]

On May 3, 2023, the NRC published a notice in the Federal Register (88 FR 27713) issuing for public comment a draft regulatory guide (DG), DG-1403, Quality Assurance Program Criteria (Design and Construction). This DG is proposed Revision 6 of RG 1.28 of the same name. The proposed revision endorses Nuclear Energy Institute (NEI)14-05A, Guidelines for the Use of Accreditation in Lieu of Commercial Grade Surveys for Procurement of Laboratory Calibration and Test Services, Revision 1, issued November 2020, as an acceptable approach for licensees and suppliers subject to the quality assurance requirements of NRC regulations. Also in this proposed revision, the NRC staff endorses the Part I and Part II requirements included in NQA-1-2017, NQA-1-2019, and NQA-1-2022 for the implementation of a quality assurance program during the design and construction phases of nuclear power plants and fuel reprocessing plants. On May 3, 2023, the NRC published a notice in the Federal Register (88 FR 27714) issuing for public comment a DG, DG-1409, Guidelines for Lightning Protection for Production and Utilization Facilities. This DG is proposed Revision 1 of RG 1.204, Guidelines for Lightning MAY 11, 2023 ENCLOSURE D

Protection of Nuclear Power Plants. DG-1409 describes an approach that is acceptable to the staff of the NRC to meet regulatory requirements for adequate lightning protection of safety-related systems, structures, and components. This DG endorses, with clarifications, the methods described in Institute of Electrical and Electronics Engineers (IEEE) Standard (Std.)

C62.23-2017, IEEE Application Guide for Surge Protection of Electric Generating Plants. Comments are due by June 2, 2023 List of Approved Spent Fuel Storage Casks: TN Americas LLC; NUHOMS EOS Dry Spent Fuel Storage System, Certificate of Compliance No. 1042, Amendment No. 3: Direct Final Rule; 10 CFR Part 72 [NRC-2023-0050; RIN 3150-AK93]

On May 2, 2023, the NRC published a direct final rule in the Federal Register (88 FR 27397) amending its spent fuel storage regulations by revising the TN Americas LLC; NUHOMS EOS Dry Spent Fuel Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 3 to Certificate of Compliance No. 1042. Amendment No. 3 revises the certificate of compliance to add three new heat load zone configurations, add a variable-lead thickness transfer cask, add ATRIUM 11 fuel as an allowable content, update the criticality evaluation, allow ultrasonic testing of the outer top cover plate weld, reduce the time limit for transfer of two heat load zone configurations, incorporate a method to determine new loading patterns, waive a fabrication pressure test requirement, and make conforming changes for consistency and terminology clarification. Amendment No. 3 also includes additional changes associated with consideration of severe weather, maintaining water in the annulus, and design changes to the Matrix Loading Crane. The companion proposed rule was also published in the Federal Register on May 2, 2023 (88 FR 27418). This direct final rule is effective July 17, 2023.

Three Mile Island Nuclear Station, Unit 2 Exemption On May 2, 2023, the NRC granted the exemption from the criticality requirements of Sections 70.24 Criticality Accident Requirements, of Title 10 of the Code of Federal Regulations Part 70 (ML23026A313), as requested in TMI-2 Solutions, LLC letter dated September 29, 2022, attachment 2, (ML22276A024). The exemption eliminates the requirements for criticality monitoring that are no longer necessary at Three Mile Island Nuclear Station, Unit 2.

Fuel Cycle Facility Stakeholder meeting On May 3, 2023, staff held the first of two bi-annual fuel facility stakeholder meetings for 2023 with representatives from the Nuclear Energy Institute, fuel cycle facility industry representatives, and members of the public. The parties discussed the status of several initiatives involving the fuel cycle industry including budget and fees, construction considerations, continued progress of Smarter Licensing and Smarter Inspection, rulemakings impact in the fuel facility community, and fuel cycle industry observations.
