Office of Nuclear Reactor Regulation Items of Interest Week Ending September 8, 2023

NRC Sponsored the Fourth Annual Higher Burnup Workshop

On August 31, 2023, the U.S. Nuclear Regulatory Commission (NRC) sponsored its fourth annual Higher Burnup (HBU) Workshop, a key activity supporting communications on Accident Tolerant Fuel (ATF) concepts. The workshop provided an overview of reactor fuel HBU and increased enrichment (IE) topics through presentations by the staff and industry. The workshop provided a forum for public questions on ATF activities, specifically, on HBU and IE issues. The event also included an NRC and industry exchange on expectations for future submittals including HBU and IE for industrys planned batch loading of ATF by the mid-to-late-2020s. The staff committed to continued interactions with industry and the public regarding HBU and IE.

The workshop had over 102 attendees.

NRC Issued Acceptance for Docketing of the Carbon Free Power Project Limited Work Authorization Application

On September 5, 2023, the NRC staff issued a letter (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23236A263) to inform Carbon Free Power Project (CFPP) that the NRC has completed its acceptance review of the CFPP application for a limited work authorization (LWA) and a related exemption request (ML23212A007 and ML23212A003, respectively.) The staff has determined that the LWA application is acceptable for docketing and the staffs goal is to complete its detailed review of the LWA application by August 2025. Regarding the staffs timeline for completing its review of the exemption request, although NuScale had requested the staff complete its review by December 2024, the staff plans to complete its review by August 2024. The exemption request and the LWA, if granted, would allow CFPP to begin certain early construction activities at the CFPP site.

SMR, LLC Informed the NRC Staff of Plans for Major Change to its Small Modular Reactor Design, SMR-160, in Response to Market Demand

On September 5, 2023, SMR, LLC (A Holtec International Company) informed the NRC staff that it plans a major change to its small modular reactor design, SMR-160, in response to market demand. The modified design will produce substantially more net electric power output than the current 160Mwe, while maintaining its passive safety features. SMR (Holtec) is actively engaged in preapplication activities with the NRC for a future submission of a construction permit application.

NRC Publicly Released a Risk Informed Assessment of the French Stress Corrosion Cracking Operational Experience Relative to the US Fleet

On September 8, 2023, NRC staff released a risk informed assessment of the French Stress Corrosion Cracking operational experience relative to US fleet (ML23236A052). Using the LIC-504 process, the staff conducted a Probabilistic Fracture Mechanics and Probabilistic Risk Assessment to assess the plant risk if the stress corrosion cracking in the safety injection system piping in the French fleet were to occur in the US pressurized water reactor fleet. The analyses, which included consideration of the geometric difference between the US and French fleet safety injection piping, expected susceptibility to this type of cracking, past inspections of

SEPTEMBER 18, 2023 ENCLOSURE C these piping locations, and the industry proposed changes to the inspection program, suggest that the risk to the US fleet is low and performance monitoring and safety margins are maintained. Due to these conclusions, the staff recommended, and management approved, no direct action, but a continued monitoring of the industry response and verification that the inspection procedures at these locations are updated. The staff plans to conduct a public meeting to discuss these finding with the industry once the industry completes their assessment.

Inflation Adjustments to the Price-Anderson Act Financial Protection Regulations: Final Rule; 10 CFR Part 140 [NRC-2023-0110; RIN 3150-AL01]

On September 5, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 60565) amending its regulations to adjust for inflation the maximum total and annual standard deferred premiums specified in the Price-Anderson Act. The NRC must perform this adjustment at least once during each 5-year period following August 20, 2003, as mandated by the Atomic Energy Act of 1954, as amended. This final rule is effective on October 5, 2023.

Increased Enrichment of Conventional and Accident Tolerant Fuel Designs for Light-Water Reactors: Regulatory Basis; Request for Comment; 10 CFR Parts 50, 51, and 71

On September 8, 2023, the NRC published a notice in the Federal Register ( 88 FR 61986) requesting comments on a regulatory basis to support a rulemaking to amend the NRC's regulations related to the use of conventional and accident tolerant light-water reactor fuel designs. The NRC's goal is to establish effective and efficient licensing of applications using fuels enriched to greater than 5.0 and less than 20.0 weight percent uranium-235. The NRC will hold a public meeting to promote a full understanding of the planned rulemaking and facilitate public comment on the regulatory basis. Comments are requested by November 22, 2023.
