Dear Ms. Bauman:

This is in response to your letter dated June 15, 1987, in which you appealed Mr. Donnie H. Grimsley's form response dateo May 14, 1987. Mr. Grimsley's form response denied portions of three documents subject to your Freedom of Information Act (F0IA) request for documents concerning the Safety Evaluation Report related to the operation of the Diablo Canyon nuclear power plant.

Units 1 and 2.

Acting on your appeal, I have carefully reviewed the record in this case and have determined that the previously withheld infomation will continue to be withheld from552(b)(7)(C)

F0IA (5 U.S.C. public disclosure and p(crsuant to Exemptions (7)(C) and (D) of theD))

Commission's regulations. Your appeal is, therefore, denied.

The Exemption (7)(C) infomation withheld in document three listed on the enclosed appendix consists of names of individuals, the release of which could reasonably be expected to constitute an unwarranted invasion of personal privacy. The Exemption (7)(D) information withheld in documents one and two listed on the enclosed appendix consists of the names and other identifying information of individuals, the release of which could reasonably be expected to disclose the identities of confidential sources. I am unable to identify any legitimate public interest in this information.

This is a final agency action. As set forth in the F0IA (5 U.S.C.

552(a)(4)(B)), juoicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia.
