CLOSURE OF INVESTIGATION(OI 4-1998-021)
Dear Mr. Rueger:
This letter is in reference to an investigation conducted by the NRC Office of Investigations (Ol) regarding activities at Diablo Canyon Nuclear Power Plant (DCNPP). The Ol investigation was initiated in response to a complaint of employment discrimination for identifying a safety concern.
Based on the evidence developed during the investigation, testimony, and document reviews, the allegation was not substantiated.
The NRC plans no further action regarding this investigation and considers this case closed.
Enclosed for your reference and information is a copy of the synopsis from Ol 4-1 998-021.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter and the enclosure will be placed in the NRC Public Document Room.

SYNOPSIS This investigation was initiated on April 28,
- 1998, by the Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region IV (RIV), to determine if a quality control specialist at Pacific Gas and Electric Company's (PGEE) Diablo Canyon Nuclear Power Plant (DCNPP) was the subject of employment discrimination by PG&E and/or DCNPP management for refusing to approve the fit up of a weld that could not be confirmed to meet procedurally mandated cleanliness requirements.
Based on the evidence developed, testimony, documentation, and a review by the technical staff and regional counsel, the allegation that the quality control specialist was the subject'mployment discrimination by his management for raising a safety concern was not substantiated.
