NRC INSPECTION REPORT 50-275/98-20; 50-323/98-20 AND NOTICE OF VIOLATION

Dear Mr. Rueger:

From December 6, 1998, through January 23, 1999, a routine inspection was conducted at your Diablo Canyon Nuclear Power Plant, Units 1 and 2, reactor facility. The enclosed report presents the scope and results of that inspection.

During the 7-week. period covered by this inspection period, your conduct of activities at the Diablo Canyon Nuclear Power Plant facilitywas generally characterized by safety-conscious operations, sound engineering and maintenance practices, and good radiation protection support.

Based on the results of this inspection, a violation of NRC requirements was identified. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding this violation are described in detail in the enclosed report. This violation involved failure to obtain transient combustible permits for storing compressed gas cylinders containing flammable hydrogen into safety-related areas.

The NRC has concluded that information regarding the reason for the violation and the corrective actions taken and planned to correct the violation and prevent recurrence is already

. adequately addressed on the docket in the enclosed report. Therefore, you are not required to respond to the violation unless the description therein does not accurately reflect your corrective actions or your position.

In that case, or if you choose to provide additional information, you should followthe instructions specified in the enclosed notice.

We are concerned with two failures of expansion joints that occurred on nonsafety-related systems that challenged operators by necessitating two unplanned downpowers in Unit 1.

These failures revealed weaknesses in your preventive maintenance program and your ability to evaluate degraded conditions. This item will remain unresolved pending completion of your maintenance preventable functional failure evaluation and NRC review of your compliance with 10 CFR 50.65, "Requirements for Monitoring the Effectiveness of Maintenance at Nuclear Power Plants," (Maintenance Rule).
