Dear Senator Wyden:

I am responding to your August 17,1998, letter regarding the U.S. Nuclear Regulatory Commission's (NRC) efforts regarding review activities for the proposed one-time shipment of

' the Trojan reactor vessel, for disposal. As indicated in your letter, you are aware that this review involves technical issues, and the staff is actively engaged in determining the adequacy .

I of this proposal and its impact on public health and safety. Also, you urged the staff to continue its active participation and complete the review by September 30,1998.

Although the review is still in process, the staff is in its final review phase and is planning to submit a paper containing the staff's recommendation for Commission review in early October 1998. This paper will allow the Commission, itself, to review the matter of granting or denying

the exemptions to the applicable transportation regulations that would be necessary to allow the Trojan reactor vessel to be shipped in the manner requested. Contingent upon a favorable determination regarding the request, the staff expects to issue the final decision in November 1998, which would allow Portland General Electric Company (PGE) sufficient time to grout the reactor vessel internals in preparation for an August 1999 shipment.

Besides NRC approval, I hasten to add that PGE must also obtain, before shipment:

(a) approval to dispose of the reactor vessel at the U.S. Ecology site in the State of Washington; (b) an exemption from the U.S. Department of Transportation (DOT) regulations; and, (c) approval of a modification to the Trojan Decommissioning Plan from the State of Oregon. We have coordinated our review schedule with DOT, the U.S. Coast Guard, and the States of Oregon and Washington. The NRC decision-making process is acting in parallel, and in concert with, othm 1ssary approvals.
