Docket No. 50-382

Dear Administrative Judges:

This sumary is being provided at the request of Administrative Judge Wolfe, Chairman of the Licensing Board, concerning the telephone conference call held on Friday, June 25, 1982.

A telephone conference call was placed by Counsel for the Staff at approximately 4:00 P.M. on Friday, June 25, 1982. Parties to the conference call were Administrative Judge Wolfe, Bruce Churchill, Esq. (Counsel for Applicant), Mr. Gary Groesch (on behalf of Joint Intervenors, in the absence of their Counsel), and Sherwin Turk (Counsel for the Staff). Counsel for the Staff requested a two week extension of time, until July 15, 1982, for the filing of the Staff's proposed findings of fact and conclusions of law.

Counsel stated, as good cause, that he had been required to devote a substan-tial amount of time to other pressing matters since the conclusion of the Waterford hearing. Joint Intervenors opposed the Staff's request; Applicant did not oppose the request and stated that it could accommodate the requested extension. Applicant sought clarification that the due date for its reply findings would be extended for two weeks, as well. The Licensing Board Chair-man noted that Joint Intervenors had recently filed a motion to reopen the hearing: which, if granted, would result in delay of the proceeding independent of the Staff's request for an extension.

Upon consideration of the parties' positions and upon finding good cause for the requested extension of time, and no resulting prejudice to Joint Intervenors or other party, the Licensing Board Chairman granted the Staff's request, and ordered that the Staff's proposed findings of fact and conclusions of law are to be filed on or before July 15, 1982, and that the h

Applicant's reply findings of fact and conclusions of law are to be filed on or before July 26, 1982.

Counsel for Applicant stated that Applicant intended to file a motion for an extension of time to respond to Joint Intervenors' Motion to reopen, until such time as the Commission has provided guidance on the issues raised by that motion. Applicant expected that such guidance will be issued shortly, possibly during the next week. The Licensing Board Chairman suggested that the parties confer and, if no agreement among the parties is reached, a motion might be filed thereafter.

Sincerely, Sherwin E. Turk Counsel for NRC Staff cc: Service List 1
