Dear Mr. Jager:

On July 21, 1976, the United States Court of Appeals. for.the District of Colu:bia directed the' Nuclear Regulatory Commission'on 2emand to reopen the issues of energy conservation alternatives, as well as recalculation of costs and benefits, as they relate to the Midland Nuc1 car Plant. The Court also directed the NRC to reopen the' issue of waste disposal in the fuel cycle 'as it relates to .the Midland Nuclear Plant and other nuclear power generating facilities.

h'e have been informed by Consumers Power that shortly there may be an evidentiary hearing on the issue of whether Consumers' construction permit should be modified or suspended pending an interim rule on the waste dis-posal issue. h'c also have been informed by Consumers that there will be q a second evidentiary hearing, which may take place before the end of the year, on the cost-benefit analysis and other Midicnd-related issues.

Either of these hearings could result in a modification or suspension of Consumers' construction permit.

Dow nay be forced to propose to the Air Pollution Control Commission broader alternatives to acet its future steam and power needs. Because of this highly fluid and uncertain situation, we feel it is inappropriate for Dow to present any plans to the Commission at this time. By January, subsequent events should clarify the situation and Dow should be abic to discuss its future plans with the Commission.
