Dear Mr.1 Brunner:

w J-I am responding to your letter of May 17, 1984 to Billie Garde and me.

Un fo r-tunately,'-you misunderstood the thrust of my letter, so I will repeat the relevant portion.

tW I am not making a formal discovery request of Consumers Power Company. Obviously,

~

my letter of May 4 was sent out prior to the Licensing Board's decision to admit two additional Stamiris contentions and set a discovery schedule on those contentions.

At;;

Rather. py letter was a request for voluntary production of certain materials which had4een produced in the Dow v. Consumers litigation which in the normal practicehof law would be available to the public generally, and to Mrs. Stamiris as a member of the public. Moreover, as Mr. Miller indicated in argument on Mrs. Stamiris' motion, he saw no problem in providing to the intervenors the materials-which Consumers produced to Dow.

There'foIel once again I will request access to those materials which are not currently _ subject to a protective order or any court order prohibiting disclosure.

Sincerely yours, 2.F N
