DOCKET liOS. 50-266 Arid 50-301 MODIFICATI0ii 0F TEQttilCAL SPECIflL&floa CNMGE REQUEST ti0. 46 POIHT ulAOI fluCLLAR PLMIT, UNITS 1 ANO 2 Your letter dated August 21, 1979, and received August 28, 1979, requested that we increase the minimum size of the fire brigade contained in the Technical Specifications for Point Beach Nuclear Plant Unit Hos.1 and 2 to five neobers within 30 days of our receipt of the letter. In accordance with this request, Wisconsin Electric Power Company hereby proposes the enclosed change to the Point Beach Technical Specifications. This change represents a modification i to facility Operating License llos. DPR-24 and DPR-27 amendment application dated July 28,1977, as subsequently modified by our letters dated October 5,1977 and Decerber 12, 1977.

Enclosure 2 of your August 21 letter at Page 3. Item 1, states the NRC opinion that designation of the Shift Supervisor as the fire brigade leader is unacceptable. tio do not agroo with this opinion. The Shift Supervisor is respon-sible for the overall operation and safety of the plant. It is his responsibility to investigate all plant emergencies, nake decisions, and direct operating and recovery actions. Regulatory Guide 1.120 Section C.l.d.(1) states that fires need not be postulated to be concurrent with non-fire related failures in safety systet.s, Other plant accidents or the most severe natural phenomena, tle see no reason why the Shift Supervisor would be required to leave the scene of the emergency.

Enclosure 1, Table 1, lists the following required actions for the l fire brigade leader.

1. Evaluate the fire (cuergency) situation.
2. Determine the effective actions to be taken.

4. Direct fire fighting activities.
5. Judge effectiveness and safety.
6. Consider alternative actions, such as need for offsite assistance.
7. Consider irpact on plant safe shutdown capability, such as equipment which may be disabled.

The above decisions directly affect plant operation and safety. Such decisions and actions are the responsibility of the Shift Supervisor, who is the shift person most knowledgeable and qualified to make these decisions and inplermint proper actions. Delegation of this responsibility to other personnel would compromise the authority and responsibility of the Shift Supervisor and would increase the potential for erroneous decisions and/or actions. For these reasons, we consider the Shift Supervisor to be the proper designec as fire brigade leader and will continua to have hin so designated. You should further note that the Point Beach iluclear Plant organization structure, which has an operating supervisor (normally SRD licensed) assigned in charge in the control room in the absence of the Shift Supervisor from the control room, provides a sound organization for allowing the Shift Supervisor to be the fire brigade leader.

e 15.6.2.2.f A Fire Brigade of at least 5 members shall be maintained onsite at all times. This excludes 3 rnorrbers of the minimum shift crew necessary for safe shutdown of the plant and any personnel required for other essential functions during a fire emergency.
