SUMMARY

OF A PUBLIC MEETING WITH SOUTHERN NUCLEAR OPERATING COMPANY ON JANUARY 10, 2019 The U.S. Nuclear Regulatory Commission (NRC) staff held a Category 1 public meeting with Southern Nuclear Operating Company (SNC) on January 10, 2019. The purpose of the meeting was to discuss issues associated with the safety review of licensing actions for SNCs Vogtle Electric Generating Plant (VEGP) Units 3 and 4.

The meeting notice can be found in the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML18353A962. The meeting notice is also posted on the NRC public website. Enclosures 1 and 2 are the meeting agenda and attendance list for the meeting, respectively. The other documents referenced during the discussion can be found at the ADAMS Accession Nos. given below:

J. Dixon-Herrity Summary of Meeting:

On January 10, 2019, staff from the NRC conducted a public meeting with representatives from SNC to discuss issues associated with the safety review of licensing actions for SNCs VEGP Units 3 and 4. Specifically, the meeting discussed (1) questions related to SNCs request for exemption from 10 CFR Part 26 visitor access requirements and (2) draft clarification questions related to LAR 18-028.

The first topic discussed was questions related to SNCs request for exemption from 10 CFR Part 26 visitor access requirements. In response to NRC staff discussion topics (see ADAMS No. ML18362A249) regarding SNCs Fitness for Duty exemption request (see ADAMS No.

ML18340A280), SNC stated the following information in response to the staff discussion topics:

  • (Item #1, Topic #1) SNC noted that a failure of the escort-visitor program, where a visitor is unfit for duty but allowed to work, would be the responsibility of the escort and repetitive failures would result in a notification to the NRC. An example of a recurrent behavior that would warrant reporting under NEI 06-06 Section 12, 2a or 2b, would be if an escort observed behavior subject to NEI 06-06 Section 12 reporting requirements listed in paragraph 3, numbered paragraph 2, but did not notify management.
  • (Item #2, Topic #2) SNC confirmed the staffs understanding and stated that fitness-for-duty (FFD) compliance would be solely the responsibility of the escort. Construction visitors would not be allowed to serve as escorts.
  • (Item #2, Topic #3) If a construction visitor violated the FFD policy, that individual would not be placed in the industry shared database. This is consistent with operating plants.
  • (Item #2, Topic #4) If the Construction Visitor violates the SNC Construction FFD policy, he/she would be immediately removed from the construction site, precluded from re-entry, and also be denied unescorted and escorted access to any of the 4 Vogtle units until the case was adjudicated. The individual would not be placed in the shared industry database.
  • (Item #3, Topic #5) SNC stated that Construction Visitors are not included in the populations described. The staff noted that the request may need to be supplemented to note this clarification.
  • (Item #4, Topic #6) A Construction Visitor would not be included within the description new or short-duration/transient construction site workforce personnel subject to the behavioral monitoring program. SNC noted that badging is the preferred method and that they currently do not anticipate a large influx of new or short-duration/transient Construction Visitors. SNC noted that the requested exemption seeks flexibility, and is not limited in scope for emergent, short term work.

J. Dixon-Herrity * (Item #5, Topic #7) SNC noted that they determine when a structure, system, or component becomes security-related or information become Safeguards Information or requires a Need-to-Know, and that the determination is dependent, in part, on the Protected Area designation.

  • (Item #6, Topic #8) SNC noted that security officers would be informed and trained in the new escort-visitor program and that escorts would use all available communication systems to immediately communicate with security. This is similar to operating plants.
  • (Item #7, Topic #10) SNC confirmed that the escort would be responsible for all assigned Construction Visitors. If an escort found that he/she was not able to handle all his/her assigned visitors, he/she would need to get support, as necessary.
  • (Item #8, Topic #11) SNC confirmed that all Construction Visitors assigned to a particular escort would be under direct observation by the escort.
  • (Item #9, Topic #12) By industry shared database, SNC is referring to the database maintained by the Nuclear Energy Institute as well as more comprehensive sources that would include those individuals who work within the Entergy and NextEra commercial power reactor fleets.
  • (Item #10, Topic #13) Persons constructing or directing the construction of safety- or security-related SSCs (as described in NEI 06-06) as specified in 10 CFR 26.4(f) would not be eligible to be construction visitors under the proposed construction visitor program.

The second topic discussed was draft clarification questions related to LAR 18-028. SNC clarified that LAR 18-028 does not propose any changes to the containment barrier or to ventilation systems. Regarding Clarification Question 1, SNC stated that the auxiliary building should be mentioned in LAR 18-028, Section 4.1. Regarding Clarification Question 2, SNC clarified that General Design Criterion 4 should be mentioned and evaluated in the LAR.

Regarding Clarification Question 3, SNC confirmed that the Division D conduit that traverses Fire Area 1201 AF 02 is associated with the main control room/remote shutdown room transfer switch function and that no other Division D components are located in the fire area. Regarding Clarification Question 4, SNC stated that the Division A cables already exist in Fire Area 1242 AF 02 and that only Division C cables are being added. SNC stated that they would voluntarily supplement the LAR to provide the requested clarifications.

At the end of the meeting, there was an opportunity for the public to provide comments and ask questions. There were no comments or questions from members of the public.
