SUMMARY

OF APRIL 18, 2023, MEETING WITH SOUTHERN NUCLEAR OPERATING COMPANY On April 18, 2023, the U.S. Nuclear Regulatory Commission (NRC) held a virtual public meeting with representatives of Southern Nuclear Operating Company (SNC or the licensee). The purpose of the meeting was to have a pre-submittal discussion of a draft license amendment request (LAR) for Vogtle Electric Generating Plant (VEGP) Unit 3. Draft LAR 23-007 proposes to revise Technical Specification (TS) 5.5.8, Containment Leakage Rate Testing Program, to extend the allowable time for conducting the first periodic Integrated Leak Rate Test (ILRT or Type A test) described in NRC Regulatory Guide 1.163, Performance-Based Containment Leak-Test Program, and Nuclear Energy institute (NEI) 94-01, Industry Guideline for Implementing Performance-Based Option of 10 CFR Part 50, Appendix J.

SNC representatives described their technical and regulatory evaluations supporting draft LAR 23-007 (ML23100A160). Delays in achieving commercial operation for VEGP Unit 3 and the need to achieve necessary fuel burnup led to the development of this draft LAR.

Below is a summary of the general comments and discussions:

The NRC staff noted the discussion of Margin on Enclosure page 4 of the draft LAR and stated that additional detailed information may be needed for the staff to review the bases for the indicated margin.

SNC representatives confirmed that the draft LAR is not a specific risk-informed request and will consider revisions to make this intention clearer.

The NRC staff requested clarification of the proposed revision to TS 5.5.8. For example, the staff considered the proposed markup that defines two conditions to be met for the performance of the first ILRT could have multiple interpretations. SNC representatives stated that the intent is for the first ILRT to meet both conditions. SNC will consider clarification of the proposed markup to TS 5.5.8 as well as providing a discussion in the LAR to illustrate how these conditions would apply to refueling outages that occur before and after May 2025.

May 10, 2023 SNC representatives confirmed that the draft LAR does not extend to the Type B and Type C tests described in 10 CFR Part 50, Appendix J.
