10 CFR 50.72 and 50.73 Applicability to Vogtle Units 3 and 4 Core and Containment Cooling Systems This memorandum clarifies the applicability of the reporting requirements in Title 10 of the Code of Federal Regulations (10 CFR) 50.72 Immediate Notification Requirements for Operating Nuclear Power Reactors and 10 CFR 50.73 Licensee Event Report System to the licensee for Vogtle Units 3 and 4 with respect to actuations of the passive core cooling system (PXS), the automatic depressurization system (ADS), and the passive containment cooling system (PCS).
The PXS, ADS, and PCS are design features of the Vogtle Units 3 and 4 AP1000 nuclear power plants currently under construction. The licensing bases for Vogtle Units 3 and 4 in the UFSAR credit the PXS and ADS as emergency core cooling systems (ECCS)1 and the PCS as a containment heat removal and depressurization system2 for satisfying the applicable regulatory requirements in 10 CFR 50.46, Acceptance Criteria for Emergency Core Cooling Systems for Light-Water Nuclear Power Reactors, and 10 CFR 50 Appendix A, General Design Criteria (GDC) for Nuclear Power Plants, GDC 35 and 38. Therefore, the reporting requirements that apply to ECCS and containment heat removal and depressurization in subsections 10 CFR 50.72(b)(2)(iv)(A), 50.72(b)(3)(iv)(A), 50.73(a)(2)(iv)(A) and 50.73(a)(1) require the licensee for Vogtle Units 3 and 4 to report actuations of the PXS, ADS, and PCS.

Bailey The applicability of these reporting requirements is not limited by the fact that some subsections of 10 CFR 50.72 and 50.73 are written to include non-exclusive examples of design features and that PXS, ADS, and PCS are not among these examples (e.g., 10 CFR 50.72(b)(3)(iv)(B)(3) refers to ECCS for PWRs, including: High-head, intermediate-head, and low-head injection systems and the low-pressure injection function of residual (decay) heat removal systems.).
The ECCS and containment heat removal and depressurization system actuation reporting requirements in 10 CFR 50.72 and 50.73 apply to the PXS, ADS, and PCS at Vogtle Units 3 and 4 because these design features are credited for ECCS and containment heat removal and depressurization in the UFSAR.
