Dear Ms. Puntenney:

This is in further response to your letter dated May 14, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), four categories of records regarding the Fermi plant.

Nine records subject to your request are investigatory recorcs compiled for law enforcement purposes and are being withheld from public disclosur-pursuant to Exemption (7)(A) of the F0IA (5 U.S.C. 552(b)(7)(A)) and 10 CFL 9.5(a)(7)(i) of the Commission's regulations because disclosure of the information would interfere with an enforcement proceeding.

The two documents listed on the enclosed Appendix C contain information the licensee considers confidential business (proprietary) information. This ;D information is being withheld from public disclosure of the F0IA (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of pursuant to Exemption (4) the Comission's regulations. We have asked the originators of this information to review their proprietary claim, and will let you know if the documents, or any portions thereof, may be disclosed to the public.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. James G.

Keppler, Regional Administrator, Region III.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days frnm the receipt of this letter. As provi< fed in 10 CFR 9.11,
