Dear Messrs. Kohn:

This is in response to your letter dated September 21, 1987, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of all records relevant to John E. Ryan, a former quality assurance auditor for audit No. 4 at Nine Mile Point Unit 2.

Your request for records specifies only Mr. Ryan's name, rather than an event at a particular facility licensed by the NRC; and your request did not have an enclosed notarized authorization from Mr. Ryan for the NRC to disclose to you any records containing personal infomation about him.

For your information, records on individuals that are maintained and retrieved by the name or personal identifier of the individual are maintained in systems of records pursuant to the provisions of the Privacy Act of 1974. Most of the NRC's systems of records cover NRC employees. I am enclosing a copy of the notice of NRC's systems of records on individuals. However, records that pertain to a specific l licensed facility, which may contain information received from or i concerning individuals, are generally maintained in files that pertain to the facility or particular activities. Therefore, in order for NRC to conduct a search for records, a requester must infom us of the specific l facility and events to which the F0IA request pertains. '

The NRC addressed records regarding certain matters regarding the Nine l Mile Point plant in response to previous requests from Mr. Ryan  ;

(F01A-85-735) and Ms. Billie Garde of your organization (F01A-85-613 and '

F01A-86-377) and a related lawsuit (Ryan v. Nuclear Regulatory Commission, D.D.C. No. 86-1553). Copies of these requests and NRC's responses are maintained in the NRC's Public Document Room,1717 H Street, NW, Washington, DC 20555.

In the event you are interested in any additional records after your inspection of the records mentioned above, please submit another F0IA request specifically describing the records. If you have any questions regarding this matter, please telephone Ms. Linda Robinson at 492-8133.
