REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE -

NINE MILE POINT NUCLEAR STATION, UNIT NO.1 Dear Mr. Mueller '

By your application dated February 3,1999 and affidavit dated January fi,1999, executed by William R. Schmidt of MPR Associates you submitted *Nine Mile Point Unit No.1 (NMP1) Core Shroud Vertical Weld Repair Design Report" and requested that it be withheld from public ,

disclosure pursuant to 10 CFR 2.790. A nonproprietary version was submitted for placement )

in the NRC public document room.

The affidavit stated that the subW.ed information should be considered exempt from mandatory public disclosure forine following reasons:

1. The information sought to be withheld from public disclosure has been held in confidence by MPR Associates.
2. The information is of a type customarily held in confidence by MPR Associates and not customarily disclosed to the public. MPR Associates has a rational basis for determining the types of information customar:ly held in confidence by it, and in that connection utilizes a system to de'. ermine when and whether to hold certain types of information in confidence. This tystem was applied in determining that the subject document herein is proprietary.
3. The information will be transmitted to the Commission in confidence under the provisions of 10 CFR 2.790 with the understanding that it is to be received in confidence by the Commission. i
4. The information, to N ".c it of my knowledge and belief, is not available in public 0 sources. / \
5. Public disclosure of the information is likely to cause substantial harm to the l competitive position of MPR Associates because: )
a. The development of the information required a considerable amount of time and i expense by MPR Associates. l P

b. For a competitor to develop the same information would require a similar or greater amount of time and expense.

c. In pricing MPA Associates products and services, significant research, development, vngineering, analytical, manufacturing, quality assurance and other costs and exf enses must be included. The ability of MPR Associates' competitors to utilize suct information without similar expenditure of resources may enable them to sell at prio ns reflecting significantly lower costs.

We have reviewed your application and the materialin accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from'public disclosure.

Therefore, the version (s) of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended Withholding from public inspection shall not affect the right, if any, of persons properly and directly concemed to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of information Act I request includes yourinformation, in all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
