Dear Mr. Dick:
This refers to your letters of January 26 and February 14, 1985 and to telephone conversations between you and Mr. W. Lazarus of this office on January 31 and February 12, 26 and 28, 1985. We have reviewed your letters in which you express several concerns relating to the Nine Mile Point Unit 2 construction project and to an NRC Readiness Assessment Team Inspection conducted at the Shoreham Nuclear Power Station.
3 As a result of your concerns, we have agreed to meet with you on March 5, 1985 to discuss these items and any other related information you wish to bring to our attention.
Our review of your letter and subsequent discussion with you indicates that many your concerns relate to alleged instances of poor management practices, unrealistic scheduling, solicitation of funding based on falso schedules, and apparent dismissal or harassment of employees who sought to identify these issues. Please note that in the case of dismissal or harassment of employees under the provisions of 10 CFR 50.7, the concerns must be brought to the attention of the Department of Labor (00L) within 30 days of the alleged dis-crimination or harassment in order for DOL to pursue an investigation, (see attached Part 24 provisions). The issues regarding unrealistic scheduling and funding should be addressed to the New York State Public Service Commission (PSC). As you have requested anonymity, we will take no action in contacting the PSC, but recommend that you contact them directly with your concerns.
