Please forgive my audacity in addressing you pe sonally on a matter of some urgency, I hope I'm not being impert 'ent'in recal-ling my past associations with you.

Thirty years ago, in 1955 to f

~be exact, we were working for the same employer, the General Flcatric Company, -We did two commercials together on the G. 1

In'1980 when I worked for the Republican National Committee, f

under Bill Brock, I was assigned to the targeted' Congressional i

campaign _for Stan'Parris, where we raised over a half-million dol-lars.

_I was his Finance Chairman.

The Reagan-Bush headquarters was'in our district of Virginia and I worked closely with your PAC

committees.

And in 1981,- I served as Director' - Ticket Operations i

j on your inaugural, (see attached).

In 1982, I left government service to accept a position with 4

a large. power-company in.New York State.

My. reason:for writing you directly is born of frustration and

futility.

In my activities with the utility, I joined with th'ree i

~

j other professional men to conduct an audit of a nuclear power plant under construction, in behalf of the Nuclear Regulatory Commission W

. e. uncovered many problems that could have long-range-serious implic-f ations on the safe operation of the plant when it starts up.

These problems are-akin to those that were discovered as.the root causes p

for the problems at Three' Mile Island...very likely more serious i

j

.because this1 plant is much bigger than Three Mile Island' i

Our efforts to effect recognition of these problems'and the j

ultimate corrective action resulted in retaliation by-the utility's

. management and onefofithefcontractors.

The. audit team members were i

harassed and intimidated. con'stantly'for one and-a-half years.

When all;available and' reasonable internal: efforts failed to' resolve this

problem,=in self-defense _the auditors launched a Federal lawsuit, i

citingLthe appropriate' federal statutes in violation ~.

'At issue here is the' Employee ' Protection' Provisions of the Energy Reorganization

'i Lact'(42 U.S.C. j5851).

At.the beginning of our efforts, the NRC's Offic'e of'Investig'ations and Enforcement-conducted an intensive investigation in 1984 lasting several months.

_The investigation was completed in December 1984 and the report was ready for release in April 1985 However, repeated con-tacts with the NRC revealed that the final report is being re-oritten by parties who had not even participated in the investigation.

NRC

-Chairman Palladino has been ir. formed of this, but he.has been non-respon-sive and the report' remains unpublished to this date.

In January.1985, the Department.of' Lab.or was inf6rmed of'our plight via proper procedures in the regulations contained in Title 29, Part 24,. Code of Federal Regulations under Public Law 95-601, Section 210 of the Energy Reorganization Act (42 U.S.C. E5851).

However, here too we found a reluctance to react in a timely or appropriate. manner.

A' j-forty-five-day turnaround procedure as stipulated by law for the DOL to act, has now been stretched into nine months with no substantive remedy in-sight.

I addressed this issue directly to Secretary of Labor Bill Brock j

on June 12 and 19 of this year and this resulted 11 an " Order of Remand" from Bill.on August 1, 1985.

While I'm pleased with the effectiveness of Bill's action, I am skeptical as to the final outcome unless the Secretary monitors this (Case No. 85-ERA-24) closely.

I am now scheduled for a hearing on September 30, 1985 - nine months later?

I am soliciting your_ personal intervention in-this matter,. since every direct effort to the NRC and, until'recently, the Department of Labor, has< resulted in procrastinations. and rebuff.

The NRC is purpose-fully uithholding an investigative report, uhich is very much in the public interest on an extremely serious issue.

This report will impact directly on the September 30th DOL' hearing ~and should be released in proper form before'that date.

Mr. President, I am respectfully requesting Executive intercession in the public interest and in'the interest of Justice for me and my co-auditors.

I request the expeditiousfrelease of the NRC report and a fairfand impartial hearing by the U. S. Department of Labor.
