Dear Mr. Ryan:
-This is in partial response to your letter dated October 31, 1985, in which
you requested, pursuant to the Freedom of Information~ Act (FOIA), a copy of
the Office of Investigations (01) report on Nine Mile Point Unit 2 related to
nuclear auditor harassment. This also responds to that portion of your
November 15, 1985, letter to Mr. Jay Gutierrez of NRC's Region I office in
which you clarified the scope of your F0IA request.
In your November 15 letter, you stated that your request relates to two
specified allegations. As Mr. Stephen Isaacs informed you on December 6,
1985, with regard to allegation No. RI-84-A-0061, a copy of the resultant NRC
Inspection Report No. 50-410/84-09 was provided by Mr. Gutierrez to your
attorney.
In addition, with regard to allegation No. RI-84-A-014, Mr. Isaacs
informed you that the resultant 01 report is currently undergoing 01
headquarters review and will not be released until that review is completed.
The 01 staff has informed this office that they anticipate the review will be
completed within the next three months. At that time, a copy of the report,
minus any identifying information (e.g., names, addresses, personal telephone
numbers, and other information identifying confidential sources) will be made
available to you.
We will notify you upon completion of the 01 review.
If you consider this
letter a denial of your F0IA request, you may submit a written appeal to the

Secretary of the Commission within 30 days from receipt of this letter.
