This is in reference to our telephone conversation of February 25,1999, during which you requested a copy of the NRC Petition Review Board (PRB) meeting summary regarding your i
letter of December 14,1998, expressing concem for the degraded core shroud and vessel intomals at Nine Mile Point Unit 1. After examining the contents of the meeting summary, the
- NRC has decided to provide you with a copy without a Freedom of Information Act (FOIA)

request because of your expressed intemst in the matter and your request to receive the information promptly, before the Unit 1 outage begins on April 11,1999. This exception is made as'a matter of courtesy since records of the PRB decisions and deliberations are normally exempt from public disclosure. The enclosure is a copy of the PRB meeting summary

I was not aware during our conversation that your letter no longer appears on the NRC's intemet webpage (http /www.nrc. gov /NRC/PUBLIC/2206/index.html) that indicates the status J
of 10 CFR 2.206 petitions. It was removed because, as indicated in the response, the NRC found that the criteria for consideration under 10 CFR 2.206 had not been met.
