c FITNESS FOR DUTY (FFD) PROGRAM PERFORMANCE DATA REPORT January 01 - June 30,1999 SECTION I.

Process Stage Data Since early in 1991, Niagara Mohawk has conducted on-site drug screening using a SYVA ETS instrument. During this time, all tests found to be "non-negative" have been sent to our Health and Human Services (HHS)-certified laboratory for both screening and confirmatory testing as applicable. To monitor our accuracy and increase the integrity of our laboratory, Niagara Mohawk has participated in proficiency testing, provided by the College of American Pathologist (CAP), since 1992.

SECTION II.

Summary of Management Actions, NRC Reportable Events, and Appeals A.

Situation Descriptions 1.

An employee tested positive for marijuana following an observed sample (categorized as "other" on page 1) requested due to low creatinine on the previous random drug and alcohol test.

2.

Four contractors tested positive for marijuana following a pre-access drug and alcohol test.

3.

Three contractors tested positive for cocaine following a pre-access drug and alcohol test.

4.

Two contractors tested positive for alcohol following a pre-access drug and alcohol test.

5.

A contractor tested positive for marijuana following a random drug and alcohol test.

6.

Four contractors were identified (on 4 different days) as potentially unfit for duty due to an odor of alcohol. They tested positive for alcohol as a result of the For-Cause tests.

One contractor tested positive for maryuana and another contractor tested positive for marijuana and cocaine (categorized as "other" on page 1) following an observed sample requested due to low specific gravity on the previous pre-access drug and alcohol test.

One contractor presented a sample for a pre-access drug and alcohol test which was determined to have a pH equal to 1.0. Another contractor

submitted a sample for a pre-access drug and alcohol test which was below the j

acceptable temperature range. This contractor then refused to provide another j

sample under observation. Both samples were consistent with adulteration which carries the same sanctions as a positive test.

B.

Management Actions in Response to Situation Description 1-8 i

The following list describes the actions taken by management as a result of the above situations:

1.

Unescorted access was immediately denied or removed and the appeal's option was explained to all individuals represented by the above FFD Violations.

2.

FFD Staff recommended the contractors seek a substance abuse evaluation to determine proper treatment and rehabilitation, as appropriate.

3.

The Niagara Mohawk employee was referred to Niagara Mohawk's Employee Assistance Program for an evaluation and a proper course of treatment.

4.

Supervision implemented a review of safety-related work performed by the individual (if unescorted access was granted prior to the violation). No remedial actions were required.

5.

A follow-up testing agreement was required prior to reinstatement of unescorted access.

C.

NRC REPORTABLE EVENTS PER 10CFR PART 26.73 There was one reportable event during this reporting period. A contractor who tested positive following a For-Cause Drug and Alcohol Test was fulfilling a supervisory position.

APPEALS A contractor who was confirmed positive for alcohol following a pre-access drug and alcohol test elected to appeal the test results. Blood was provided for further analysis y h'ch confirmed the alcohol level. The Appeal's Officer informed the individual that all procedures were followed correctly and the decision to deny unescorted access remained.

SECTION III.

FFD Program Modifications and Lessons Learned During this reporting period, Niagara Mohawk evaluated the NRC Information Notice (IN) 99-08, URINE SPECIMEN ADULTERATION, which described the use of an adulterant to subvert the testing process. In response to this IN, Niagara Mohawk has requested that our contracted HHS-certified laboratory check each sample received for Nitrite and Pyridinium Chlorochromate.

At the request of Rochester Gas & Electric, Niagara Mohawk provided on-site initial drug testing at the Ginna Nuclear Station to expedite contractor in-processing in support of their refueling outage, i

Niagara Mohawk conducted an annual internal Quality Assurance / FFD audit during this reporting period, As a result, inadequate procedural direction for FFD records management was identified. All records generated by the FFD program are being properly retained by the I

FFD organization, but the process is not appropriately procedurally controlled.

SECTION IV.

Data Assessment and Program Evaluation A review of the data contained in this report shows thai our program is effective in controlling the incidence of drug and alcohol use at Niagara Mohawk's Nine Mile Point Nuclear Station.

Statistically, the data shows that the Niagara Mohawk employee overall positive test rate for this reporting period was 0.18%, and for contractors was 1.56%. Additionally, the comNned positive test rate for contractors and Niagara McNawk employees is approximately 1.11 % for this time period (0.68% since the inception).

In summary, Niagara Mohawk is committed to continually improving our FFD program by evaluating and correcting weaknesses to ensure our work force operates in a safe and reliable environment.
