By your letter dated June 29,1999, you submitted on behalf of Niagara Mohawk Power i
Corporation (NMPC) written comments addressing a 10 CFR 2.206 petition (Petition) dated April 5,1999, submitted by Mr. Robert Norway. Your letter was in response to a May 10,1999, j
letter from the U.S. Nuclear Regulatory Commission (NRC) requesting NMPC's comments.
l You requested that your letter and its attached response be withheld from public disclosure pursuant to 10 CFR 2.790(a)(6).
Your reason for requesting our withholding of this information was that release would constitute an unwarranted invasion of personal privacy.
We have reviewed your letter and related documents in accordance with the requirements of 10 CFR 2.790. Considering the information already publicly available as part of the Department of Labor's records, the NRC's prior enforcement activities, and Mr. Norway's letter of April 5, 1999, we find nothing in your submittal that would represent an unwarranted invasion of Mr. Norway's personal privacy.
Accordingly, we have concluded that the information sought to be withheld from public y
disclosure does not meet the requirements of 10 CFR 2.790. Therefore, your request to withhold your letter and its attached response from public disclosure is denied.
In 10 working days from the date of this letter, your letter and response will be placed in the Public Document Room. If, within those 10 working days,'you request withdrawal of tha document in accordance with 10 CFR 2.790(c), your request will be considered in light of applicable statutes and regulations and a determination made whether the document will be withheld from public disclosure and returned to you.
