REQUEST FOR COMMENTS ON 10 CFR 2.206 PETITION, NINE MILE POINT NUCLEAR STATION, UNIT NOS.1 AND 2 (TAC NOS, MA5378 AND MA5379) 1
Dear Mr. Mueller:
By. letter to the U.S. Nuclear Regulatory Commission (NRC) dated April 5,1999, a former employee of Niagara Mohawk Power Corporation (NMPC) has submitted a petition, pursuant to 10 CFR 2.206, claiming deliberate violation of NRC regulations and potential criminal violation Mf federallaws by certain NMPC senior managers. The petitioner asserts that NMPC's actions, in combination with related NRC actions, "resulted in the placement of a confidential and fraudulent employee evaluation, along with a fraudulent iisting of the finding of the [U.S.
Department of Labor's] Administrative Law Judge in Discrimination Case 95-ERA-005, and i
' confidential information pertaining to [his) work performance into...the Public Document Room."
- Enclosure 1 is a copy of the petition. 'A copy was also faxed to Mr. S. Leonard of your organization on May 5,1999.
We request that NMPC provide written comments to the NRC addressing the petitioner's expressed concerns that involve NMPC activities. Your comments will be considered by the Director, Office of Nuclear Reactor Regulation, regarding his decision as to an appropriate response to the issues and enforcement sanctions requested in the petition.
The schedule for your response was discussed with Mr. Leonard. Based upon that discussion,
