Request for additional information (TAC No. MA1935) regarding the University of Virginia " CAVALIER" (Docket No. 50-396, License R-123) Technical Specification Amendment Request.

DearMr. Adams:

i We offer the following in answer to the NRC's request for additional information:

NRC Question 1:

In technical specification (TS) 6.2, Review and Audit, you have changed the Reactor Safety Committee reponing from the President of the University to the Chair of the Radiation Safety Committee. Pleasejustify the proposed change.

The President of the University of Virginia askedfor this reporting change to be made because he has become burdened with a greater number ofresponsibilities and demands upon his time.

Thus, his designatedfocalpoint at the Universityfor allNRC-regulated activities, including those at the Hospital and the Reactor Facility, is the Chair of the Radiation Safety Cornmittee.

The Chair has the authority to cmnmit universitypersonnel andfinancial resources quickly should a situation arise warranting an immediate response. He also has direct access to the highest levels of the University administration. 7herefore, the change in reporting enhances the protection of the health and welfare of the University community and the public at large.

NRC Question 2:

! In TS 6.6 you have proposed changes to the wording of the introduction of the TS without providingjustification. Pleasejustify your proposed changes.

The pendingprcposed introduction to TS 6.6, Reporting Requirements, reads:

"In addition to the requirements of the applicable regadations (such as 10CFR20, 30.50, 40.60, and 70.50, as applicable), reports should be made to the U.S. NuclearRegidatory Commission asfollows " U l V '

,. n The current wording which we have askedNRC approval to change reads: )

"In additidn to the requirements ofapplicable regidations (such as described in Regulatory Guide 10.1 " Compilation ofReporting Requirementsfor Persons Subject to NRC Regidations" and NUREG-1022, Licensee Event Report System "), reports should be made to the U.S. Nuclear Regidatory Commission asfollows:"

The pending proposed wording reflects wording used in the more recently revised UVAR TS, .j specifically, the wording used in the specifications section of UVAR TS 6.7, . Reporting Requirements. The new wording directs the licensee (us) to the sections in the Code ofFederal Regidations which should be conndredwhenformulating the reports. Therefore, the proposed wording is an improvement over thepresent wording usedin the CA VALIER Technical Specifications.

We will be happy to provide additional information or clarification should that become necessary.
